The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present:  Chairman Douglas L. Thompson, Vice-Chairman Pat Hickerson, Keja Whiteman, Dennis Christensen and Travis Becker.   County Clerk and Clerk of the Board Julie A. Freese was present.

 

Pat Hickerson moved, Dennis Christensen seconded, to approve the Agenda as amended.  Motion carried unanimously.

 

Travis Becker moved, Keja Whiteman seconded, to approve the Minutes of the May 21, 2012 Special Meeting for budget hearings and the May 22, 2012 Regular Meeting.  Motion carried unanimously.

The following items in the Signature File were reviewed: 1) Abatement Summary cover sheets; 2) Cooperative Law Enforcement Annual Operating Plan and Financial Plan between Fremont County Sheriff’s Office and the USDA, Forest Service, Shoshone National Forest (taken under advisement); and 3) Record of Proceedings.  Pat Hickerson moved, Dennis Christensen seconded, to approve a County Wide Consensus Block Grant Application Form for BFY13/14 funding through the State Lands and Investments Board.  Motion carried unanimously.  Pat Hickerson moved, Keja Whiteman seconded, to approve a TeleDoc Services Agreement and Business Associate Agreement for the Fremont County Health Benefit Plan.  Motion carried unanimously.  Pat Hickerson moved, Keja Whiteman seconded, to approve a Contract between the Wyoming Department of Health, Public Health Division and Fremont County Public Health.  Motion carried unanimously.  Pat Hickerson moved, Keja Whiteman seconded, to approve Amendment One to the Contract between Wyoming Department of Health, Division of Health Care Financing and Fremont County Public Health Nursing.  Motion carried unanimously.  Pat Hickerson moved, Dennis Christensen seconded, to approve a Legal Services Contract between Fremont County, Wyoming and Terrance R. Martin for six months.  Motion carried unanimously.  Pat Hickerson moved, Travis Becker seconded, to approve a License for New Construction of Utility Crossing or Encroachment submitted by Michael Pedersen for Angler Road.  Motion carried unanimously.

 

Transportation Superintendent Dave Pendleton reviewed bids received for the Cold Mix Stockpiling 2012 project and stated Western Wyoming Construction, Co. was the low bidder at $384,250.  The bid is for 2,500 ton to be delivered at the Lander Shop Yard and 3,000 ton to the Riverton Shop Yard.  Travis Becker moved, Pat Hickerson seconded, to accept the low bid from Western Wyoming Construction, Co. for the Cold Mix Stockpiling 2012 project in the amount of $384,250.  Motion carried unanimously.

 

Choice Engineering Services surveyor Dave Fehringer joined Dave Pendleton and distributed survey documents showing existing and proposed right-of-way boundaries for the following Dubois area Roads:  Union Pass, Warm Springs, Soda Springs, Mustang Drive and Kingfisher.  The Board took the documents under advisement following discussion regarding appropriate procedures to correct the rights-of-way to the actual road locations on the ground.  Discussion ensued regarding necessary public hearings to inform area residents of the County’s intent to correct the right-of-ways, etc.  Deputy County Attorney Jodi Darrough was asked to research different methods of correcting the discrepancies.

 

In other business, Dave Pendleton presented a Vacation and Relinquishment of Easement from Fremont County to the Kenton J. Standridge Living Trust, in relation to the Burma Road reconstruction project.  Dennis Christensen moved, Pat Hickerson seconded, to approve the document as presented.  Motion carried unanimously.

 

A Public Hearing was held at 10:00 a.m., as advertised, regarding Title III County Funds.  Under Section 601(a) Secure Rural Schools and Community Self-Determination Act of 2000, reauthorized as part of Public Law 110-343, the public notice was published with the 45 day comment period for the following proposed projects for the calendar year 2012:  Firewise Programs – $61,000; Emergency Services – $61,239; and Develop and Update Wildfire Protection Plans – $10,000.  There were no comments, either written or verbal, received on the topic.  The public hearing was closed at 10:10 a.m.

 

A Public Hearing was held at 10:10 a.m., as advertised, regarding Budget Amendment No. 15.  County Clerk Julie Freese and Financial Assistant Mike Stalder were present.  Also present in the audience were Sheriff Skip Hornecker and Treasurer Scott Harnsberger.  Keja Whiteman moved, Dennis Christensen seconded, to approve Resolution 2012-14.  Motion carried unanimously.

Financial Assistant Mike Stalder proceeded to present a preliminary budget hearing.  Advertisement will take place and the official hearing will be held during the June 19th meeting.

 

IDEA, Inc. President Alan Moore, Executive Director Phil Christopherson and Directors Dennis Heckart and __ Dennison thanked the Board for sponsoring a Business Ready Community Grant and Loan Program Subreceipient Grant Agreement between Fremont County and IDEA, Inc. for the Riverton Alco Building and Site Development Project.  Wyoming Business Council Director Roger Bower, Treasurer Scott Harnsberger and Deputy Jim Massman were present in the audience.  The representatives provided a history of the Building that was built in 1985 for Alco and then set vacant from 1995 through 2009.  IDEA, Inc. acquired this property with the grant proceeds and was able to rent space to Legacy Moulding, Co.  They feel that because this Company was in Fremont County, Brunton was able to return as the Company could provide the necessary injection moulding.  IDEA, Inc. partnered with Smith’s to repave the entire parking lot and reconstruct drains.  This in turn attracted Beal’s to rent store space in September, 2011.  In a related item, an adjacent store, Maurice’s, has also expanded their space to enhance the mini-mall.  Moore stated his concern that their organization should be notified by the WBC when they submit a reimbursement to the County.  Massman stated that the majority of grants run through the County are reimbursable and that when a fund is established, it earns it own share of investment income; likewise, it the balance runs in the negative, it would incur its share there as well.  Both Harnsberger and Massman stated Christopherson was excellent to work with and he submitted the required monthly reports on a timely basis.  Dennison gave an update on the amount of employees at the two businesses in the building.  The group’s focus is to get buildings improved for occupancy and sustainability.

 

Lander Circuit Court Budget Hearing. Present was Judge Robert Denhardt.  Last year’s request was $13,681.  This year’s request is $11,681.  This money is used to reimburse telephone and postage.  They need 3 more microphones in the court room.  They also still have rental payments through capital revolving.  The postage and telephone costs will be reimbursed by the state.

 

The previously titled Detention Facility Endowment Trust Fund was reviewed under its new name “Detention Facility Permanent Trust Fund”.  Present were Treasurer Scott Harnsberger, Sheriff Skip Hornecker and Building Maintenance Supervisor J.R. Oakley.  Detention IT employee, Jesse Lyles, was present in the audience.  A revised Policy was reviewed that clarifies replacement of major building components and detention equipment with a value in excess of $2,500.  Discussion was held regarding the corpus and its definition as well as a legal clarification on the endowment.  Travis Becker moved, Pat Hickerson seconded, to approve the revised Statement of Detention Facility Permanent Trust Fund policy.  Motion carried unanimously.

 

Detention Facility Permanent Trust Fund Budget Hearing.  Present was Treasurer Scott Harnsberger, Sheriff Skip Hornecker and Building Maintenance Supervisor J.R. Oakley.  Following a meeting by the Commissioner Becker, Sheriff, Treasurer, Clerk and JR, the endowment policy was adjusted.  Scott discussed the changes which include the name of the fund requesting to change it to the Fremont County Detention Facility Permanent Trust Fund.  Other changes were to decrease the threshold to replace or repair items from $5,000 to $2,500.  An emergency replacement component was also included.  Scott intends to have a fund balance of $4,200,000 onJuly 1, 2012.  The return on investment is based on a cash balance of $4,208,000 and projected to earn a rate of 2.5%.  Scott suggests a provision of $22,000 for utilities and $3,000 for water closet repair, $8,000 for security door repair and $4,000 for a commercial refrigerator.  Another $2,500 for painting is also included which is an ongoing expense.  These amounts will be included in the Building Detention budget.  A list from the Sheriff on equipment in his fixed assets is still needed by the Treasurer.

 

Executive Health Committee members Jim Massman and Margy Irvine reviewed a HIPAA Exemption Election Document.  The document states that Fremont County elects to exempt the Fremont County Benefits Plan from the following requirements of Title XXVII of the Public Health Services Act: Parity in the application of certain limits to mental health benefits.  Keja Whiteman moved, Pat Hickerson seconded, to approve the HIPAA Exemption Election Document as presented.  Motion carried unanimously.

 

County Planner Ray Price presented a plat for Prickly Pear Subdivision, a proposed five lot simple subdivision located northeast of Riverton on the north side of Mazet Road.  It was recommended for approval by the Planning Commission on a unanimous vote.  Travis Becker moved, Dennis Christensen seconded, to approve Prickly Pear Subdivision.  Motion carried unanimously.

 

Ray Price submitted a Re-Plat of Lots 2 and 3, Cooper Subdivision.  The proposed re-plat will enlarge Lot 2 from 5.94 acres to 11.03 acres and downsize Lot 3 from 6.10 acres to 1.01 acres.  This subdivision was approved in 2008 and is located northeast of Riverton on the east side of Hutchison Road.  The re-plat was unanimously approved by the Planning Commission.  Travis Becker moved, Keja Whiteman seconded, to approve the Re-Plat of Lots 2 & 3, Cooper Subdivision.  Motion carried unanimously.

 

In final business, Ray Price presented a plat for Kinnear Lake Ranchette Subdivision, a proposed one lot simple subdivision located southeast of Kinnear on Big Ridge Lane.  This was approved by the Planning Commission on a unanimous vote.  Commissioner Whiteman questioned whether individual tribal allottees were notified of the proposed Subdivision and Price stated their policy to notify the Shoshone and Arapaho Tribe’s office only.  She volunteered to work with the Planning Department to come up with individual allottee names as well as the Tribal Offices for future notifications involving allotted tribal lands.  There was also a question regarding ownership of the Road to the subdivision, and the Board took the plat under advisement, pending further information.

 

Pat Hickerson moved, Travis Becker seconded, to adjourn into Executive Session with County Attorney Brian Varn and Deputies Jodi Darrough and Tom Majdic for Litigation and Personnel.  Motion carried unanimously.  Travis Becker moved, Dennis Christensen seconded, to return to Regular Session.  Motion carried unanimously.

 

Travis Becker moved, Dennis Christensen seconded, to approve and sign the Bunker Road Memorandum of Understanding.  Motion carried unanimously.  Deputy County Attorney Jodi Darrough stated a Public Hearing will need to be scheduled, pursuant to Resolution 2011-28 “Alteration of Bunker Road and Vacation of the Altered Portion”.  At the same time, testimony will be heard regarding damage claims submitted by neighboring landowners.  A tentative date of June 19th was set, pending concurrence with Hearing Officer Travis Moffat.  The previous hearing regarding Seasonal Road Closure and decision could be handled at the same time.  Darrough further stated that at the conclusion of the hearing, all enactments of the MOU would go forward.

 

PAWS Budget Hearing.  Present were:  Kent Moss, Pamela Canham, Mandy Apodaca and Gina Gladhan.  They last asked for funds in 2008 and were successful in receiving $48,000 to help put on a section for county dogs.  The only problem they are having is that the area is outside and they wish to be able to make it covered to better hold the dogs.  Sheriff Hornecker stated his appreciation to PAWS for the help but it is constantly full and they could probably use a larger area.  The organization has a balance of $11,000 out of the money they received from the county in 2008.

 

E-911 Budget Hearing.  Present was Sheriff Hornecker and Carl Freeman.  They are going to recommend leaving the surcharge at $.50 for both land and wireless lines.  Maintenance fees are increasing at a rate of approximately 10%.  They receive funds from 30 organizations in the county.  Carl stated that the revenue for the land line will increase to $68,275 from an estimated $65,500 this year.  The wireless revenue will increase to $189,200 from a projected $172,000.  An itemized list of replacements was requested and Carl will work to get this list together.

 

Sheriff Hornecker reviewed concerns the Board had expressed earlier in the morning regarding a Cooperative Law Enforcement Annual Operating Plan and Financial Plan between his Office and the USDA, Forest Service, Shoshone National Forest.  He reviewed the Board’s earlier concerns by stating he had increased the hourly rate, expanded patrol opportunity to use the allotted budget and dictating how law enforcement efforts would be conducted in Fremont County.  Pat Hickerson moved, Keja Whiteman seconded, to approve Modification 1 to the Cooperative Law Enforcement Agreement with the Shoshone National Forest.  Motion carried unanimously.

 

County Coroner Budget (updated).  Present was County Coroner Ed McAuslan.  Mark Stratmoen was present in the audience.  The commissioners had requested that Ed return to discuss his budget again with an emphasis on employee costs.  Ed’s Administrative Assistant is Mark Stratmoen and he receives a salary.  He is also Ed’s Chief Deputy and gets extra money as a deputy when he’s on a call over the 40 hour week.  Erin Ivie works as a deputy supervisor in the Lander area.  She supervises approximately 8 Lander area deputies.  They are not full time employees.  The rest of his deputy’s job classifications are changing to the title of occasional which will help with not having to pay overtime when they work (if they already work for the county).  Discussion was held regarding employees receiving two types of pay.  Ed explained that the two jobs are very different jobs.  Commissioner Thompson asked what a deputy coroner does.  McAuslan responded that they doing statutorily defined tasks such as determining the manner of death and investigate the scene if it appears to be a crime.  The Chief Deputy is responsible in Ed’s absence and supervises both of the other supervisors.  Ed stated that his other deputies (not named on the salary sheet) do the same duties if they are acting as a deputy on the scene.  Ed suggested that he combine the Administrative Assistant and Chief Deputy into the same title if that will help.  Ed outlined a coroner call and how it’s determined who will respond.  He does try to have 2 deputies respond because he thinks it’s not proper to ask family members to help move the body.  Commissioner Hickerson stated his concern with his travel line item.  The history in his budget is that he spends about $8500 a year and Ed has requested $6500.  A majority of the travel is to transport bodies and it’s hard to know how much he will travel in a year.  Ed will work on the job classification adjustments and report those back to the commissioners.

County Clerk Freese reviewed the last 11 months of Coroner Deputy salaries and extra pay and an estimate of what they might receive through the end of the fiscal year.  She had discussed this with Coroner McAuslan and asked him to do a compilation of what their individual duties are, how he pays them and how he plans on saving money in the future.  She also talked about the possibility of Mark Stratmoen being reclassified as a Chief Deputy who would also be an exempt employee.

Commissioner Christensen reported on a meeting he had with Coroner McAuslan and Vehicle Maintenance Supervisor Glen Steers regarding the ongoing issue of Coroner graphics.  After that meeting, a tentative decision was made to allow the Coroner to use magnetic signs stating Fremont County Coroner, when he deemed it appropriate.  If the Office was using the emergency red lights, it would also be required to have the Coroner logo displayed.  Following the meeting, Commissioner Christensen had another option and that is to have the Fremont County Coroner logo permanently on the vehicles and have a plain magnetic piece to place over the log when needed.  McAuslan stated he would only agree with a plain vehicle with a magnetic sheet to place on the vehicle, stating Fremont County Coroner.  As no conclusion could be reached unanimously, the Board stated they would let McAuslan know their final determination.

 

County Clerk Julie Freese and Financial Assistant Mike Stalder presented preliminary budget figures, based on an assessed valuation of $990,000,000 and using the static budgets presented by the Departments.  She had inserted all health insurance costs, capital revolving lease payments and Elected Officials salary increases.  The Clerk was asked to a two year projection as the current budget would have a $1.7 million additional reserve.  The Board scheduled a Budget Work Session on June 25, 2012 at 1:00 p.m.

 

Commissioner meeting reports were given:

 

Commissioner Becker attended the May 31st Planning Commission meeting and stated the three subdivisions approved during that meeting were presented to the Commissioners earlier in the day.  He and Commissioner Whiteman met with City of Riverton and CWC representatives regarding possible plans for the Major property. He would like to continue discussion on this topic again later in July after the budget is finalized.

 

Commissioner Hickerson reported on numerous concerns regarding reduced hours for transfer stations around the County and plans to attend a public hearing on Thursday in Atlantic City regarding this issue.  He and Chairman Thompson plan to attend the WCCA and NEPA training to be held in Rock Springs on June 11-12, 2012.

 

In other business, he reviewed various issues regarding the Pioneer Museum Director that concern the Commission.  He read a letter that he recommended be sent to her requesting she consider resigning as Director.  Pat Hickerson moved, Travis Becker seconded, to send the letter to request the Director resign as Director of the Fremont County Pioneer Museum.  Motion carried unanimously.

 

Chairman Thompson reiterated his concerns with the reduced hours for transfer stations.  He stated Jeffrey City individuals volunteered to help but were ignored.  He is concerned that people will put garbage in draws if they find the transfer stations closed when they arrive.  The Board stated they would like the Solid Waste Board to attend an upcoming Commission meeting to further discuss this situation.  Commissioner Thompson was contacted from a group wanting to hold a national meeting in Fremont County regarding fracking.  He requested the group consider another County for their meeting.

 

Commissioner Christensen reported on the meeting he attended in Pavillion hosted by Governor Mead.  $750,000 has been appropriated by the State for cisterns and he stated there are still issues from parties who feel they have been ignored.  On Saturday, he had a chance to personally have a family member require the assistance of Classic Life Flight in which a transfer was necessary from Lander to Riverton before they could board the plane to fly to Salt Lake City.

 

Commissioner Whiteman reported on the meeting with CWC and Riverton officials regarding the Major property as well as her attendance at the WYDOT STIP meeting held the previous week where 17 Mile Road funding shortfalls were discussed.

 

County Clerk Julie Freese followed discussions from the previous meeting regarding a suggested change for Emergency Medical Technician description in the Fremont County Personnel Policy Handbook to read as follows:  “Non-Benefitted.  Emergency Medical Personnel working as a non-benefitted employee who may work a set or regular schedule per week or per month, and who may incur overtime from time to time based on demand.  Employee typically sets availability, unlike Full-time or Part-time employee.  Employee is covered by Worker’s Compensation and liability insurance.”  Pat Hickerson moved, Travis Becker seconded, to approve the Policy Change for definition of Emergency Medical Technicians.  Motion carried unanimously.

 

Julie Freese stated she would participate in a conference call the following day regarding an overview of a proposed new credit card opportunity.  She invited the Board to participate at 2:30 p.m. if they were interested.

 

The County Commissioner Scholarship renewal application was reviewed.  One renewal is awarded by the Board on an annual basis in the amount of $500/semester at the University of Wyoming or Wyoming Community College and applicants are required to have a cumulative grade point average of 2.5.  Keja Whiteman moved, Dennis Christensen seconded, to award the Scholarship to Sierra Collver who is attending the University of Wyoming.  Motion carried unanimously.

 

There being no further business, Travis Becker moved, Dennis Christensen seconded, to adjourn the meeting at 5:30 p.m. and reconvene at 9:00 a.m. on June 19, 2012 for a Regular Meeting.  Motion carried unanimously.
