The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present:  Chairman Douglas L. Thompson, Vice-Chairman Pat Hickerson, Keja Whiteman, Dennis Christensen and Travis Becker.   County Clerk and Clerk of the Board Julie A. Freese was present.

 

Travis Becker moved, Dennis Christensen seconded, to approve the Agenda, as amended.  Motion carried unanimously.

 

Dennis Christensen moved, Keja Whiteman seconded, to approve the Minutes of the June 26, 2012 Regular Meeting.  Motion carried unanimously.

 

Pat Hickerson moved, Keja Whiteman seconded, to accept the bills for payment, with the exception of a voucher to Davis Funeral Home for an indigent veteran burial.  Motion carried unanimously.  Pat Hickerson moved, Dennis Christensen seconded, to pay the Davis Funeral Home voucher at an adjusted amount of $1,800, as per policy.  Motion carried unanimously.

Travis Becker moved, Keja Whiteman seconded, to accept a bill from EBMS for health insurance claims in the amount of $25,271.49.  Motion carried unanimously.

 

Fremont County Fire Warden Craig Haslam reviewed the Commission’s actions of June 29, 2012 to accept his recommendation to implement a fire ban, pursuant to Resolution 2012-17.  The restrictions would prohibit any open fire or discharge of any Class A, B and/or C fireworks on all state and private land.  The City of Lander and Town of Dubois have both cancelled their public fireworks displays.   He has been monitoring maps that show severe fire danger (red) conditions, with 2/3 of Fremont County in this category.   This status is expected to continue for the next several days.  There are currently 39 active fires in this region, both in Wyoming and surrounding states.   Fremont County is experiencing unprecedented conditions as it has not been this dry this early in the year.  As a result, he felt he had no other option than to ask for the fire ban.   The Governor has stated all personnel are currently committed on active fires and has further asked all counties to implement a fire ban.  Haslam stated conditions are very different this year, mostly due to the high winds we have experienced, and the County may have trouble getting sufficient resources if a new fire breaks out.  Craig Haslam stated a major concern with fall out areas and noted the aerial fireworks are the most dangerous in these conditions.

 

1838 Rendezvous Association representatives Kyle Lehto, Mike Lewis and Richard Lechner reviewed precautions their Association was taking during their re-enactment scheduled over the 4th of July holiday.  Fire Warden Haslam had allowed them to proceed with their events as they have implemented a dog soldier fire patrol, will only be using campfire rings with charcoal coals only and will have grates over fire barrels.

 

Sheriff Hornecker stated he hopes people will abide by the Resolution; however, stated it is difficult to enforce.  His patrol deputies will issue a warning initially and then follow up with a citation if warranted.  He does feel people as a whole will follow the fireworks restrictions put in place by the Resolution.

 

Flying Phoenix owner Jim Landis stated his 40 year residence in Fremont County and stated there were three other times in the history of Fremont County where fire restrictions were put into place; however, he stated the County had never totally banned fireworks on July 4th.   He further stated that he had voluntarily pulled bottle rockets from his store and noted there is no wind predicted for July 4th.  He requested the Board let people celebrate on their private land on July 4th as there is a lot of confusion to those people already purchasing fireworks.

 

Verner Haas, Cracker Box Fireworks, stated he has implemented a fireworks safety program with the general public in the past years which has reduced the amount of fires/accidents considerably.  He asked for consideration of amending the resolution to allow fireworks on July 4th only.

 

Frances Brown spoke as a citizen of Fremont County, and suggested ground fireworks only.  She further stated a concern with discussing this situation the day before July 4th and stated it should have been handled last week before people purchased fireworks.

 

Commissioner Whiteman stated there should be some sort of compromise that could be found.  Discussion was held regarding the following amendments to the Resolution:  A restriction of only ground based fireworks which do not rise over 10 feet high or project over a 10 foot radius and do not shower sparks, using fireworks in appropriate areas consisting of irrigated or thoroughly sprinkled ground and/or cleared area and restricting the use between the hours of 8:00 a.m. and midnight on July 4th only.  Vice-Chairman Hickerson stated the importance of adding smoking restrictions.

 

Keja Whiteman moved, Travis Becker seconded, to approve Resolution 2012-17 as amended.  Motion carried unanimously.

 

RESOLUTION NO. 2012-17
ESTABLISHING FIRE RESTRICTION FOR FREMONT COUNTY

WHEREAS, based upon recommendation of the County Fire Warden, the board of Fremont CountyCommissioners are empowered by Wyoming Statute §35-9-301 through 35-9-304 to close areas to fire when fire danger in the county is extreme because of drought, the presence of any excessive amount of flammable material or for any other sufficient reason; and

WHEREAS, the County Fire Warden has recommended an open fire and firework ban on all state and private land within Fremont County; and

WHEREAS the Board ofFremont CountyCommissioners find there is an extreme danger of fire throughoutFremont Countybecause of drought conditions and there is a presence of an excessive amounts of flammable materials and the high fire danger is aggravated by open burning and the use of incendiary devices;

NOW THEREFOR, BE IT RESOLVED BY THE BOARD OF  FREMONT COUNTY COMMISSIONERS;

1. Effective JULY 2, at 12:00 P.M. until further notice of this Board, any open fire or discharge of any Class A, B, and/or C fireworks is prohibited on all state and private land including, but not limited to, all lands inFremont Countyor in whichFremont Countyholds or owns an interest, including county roads, easements and rights-of-way inFremont County. The prohibition is subject to the following exception:

A. Trash or refuse burned between the hours of 6:00 p.m. and 8:00 a.m. inside containers equipped with spark arresters and are located within a cleared area that has at least ten (10) foot radius, and comply with all other laws and requirements.

B. Camp fires contained within an established fire ring, or portable fire pits with screens or spark arrestor systems.

C. Charcoal fires within enclosed grills

D. Use of acetylene cutting torches or electric arc welder provided the torches or welders are used within cleared area with at least a ten (10) foot radius.

E. Propane or open fire branding activities provided the branding activities are conducted within a cleared area with at least a ten (10) foot radius.

F. Use of chain saw provided the chain saw has spark arresters properly installed and functioning.

G. Federal, State or local fire or law enforcement officers participating in fire, emergency, and law enforcement activities.

H. Public-sponsored fireworks display which are coordinated with the County Fire Warden or his designee.

I.  Smoking in an enclosed vehicle or building, a developed recreation site, or while stopped in an area at least three feet in diameter that is barren or cleared of all flammable materials.

J.  Ground-based fireworks which do not rise over 10 feet high or project over a 10-foot radius and which do not shower sparks  may be used in appropriate areas consisting of thoroughly irrigated or thoroughly sprinkled ground and/or in a cleared area between the hours of 8 a.m. and midnight on July 4th only.

2. The County Fire Warden shall promptly notify the Board of County Commissioners of any changes in the severity of the fire danger.

BE IT FURTHER RESOLVED, that penalties provided in W.S. § 35-9-304  and W.S. §35-10-207 may be imposed for violations of this resolution; specifically, a fine not to exceed one hundred dollars ($100.00) or imprisonment not to exceed thirty (30) days or both to which may be added cost of restitution.

BE IT FURTHER RESOLVED, that the County Fire Warden shall immediately notify the Wyoming State Forester of the limitation provided for by this Resolution, as well as any and all Commissioners’ Rules and Regulations and shall assist in public notification by posting the order and circulating it to all local media.

Keith Janson was present to express concerns with the transfer station issue in Shoshoni.  He attended the recent Town Council meeting and did not receive answers to his questions from the Solid Waste Board members in attendance.  The Commissioners invited him back to the following meeting when Solid Waste Disposal District board members would be in attendance to discuss the transfer station status with the Commissioners.

 

Travis Becker moved, Dennis Christensen seconded, to adjourn into Executive Session with Vehicle Maintenance Supervisor Glen Steers regarding personnel.  Motion carried unanimously.  Following that session, the Board continued in Executive Session regarding a personnel matter.  Pat Hickerson moved, Dennis Christensen seconded, to return to Regular Session.  Motion carried unanimously.

 

Dennis Christensen moved, Keja Whiteman seconded, to approve the Vehicle Maintenance Supervisor’s recommendation on the successful Mechanic applicant.  Motion carried unanimously.

 

The following items in the Signature File were addressed:  1) Record of proceedings; and 2) letter from Riverton City Administrator regarding additional two acres to Grant of Land to City of Riverton from County.    Dennis Christensen moved, Keja Whiteman seconded, to approve a Memorandum of Understanding between Fremont County and the University of Wyoming and Commissioner of Fremont County.  Motion carried unanimously.  Dennis Christensen moved, Keja Whiteman seconded, to approve the updated Memorandum of Understanding between the Wyoming Guardian Ad Litem program and Fremont County.  Motion carried unanimously.  Dennis Christensen moved, Pat Hickerson seconded, to approve the following Licenses for New Construction of Utility Crossing or Encroachment: High Plains Power for Red Canyon Road, Shady Lane and Badwater Roads.  Motion carried unanimously.  Dennis Christensen moved, Pat Hickerson seconded, to approve an Application/Permit to Construct Access Driveway submitted by Patrick Veach for Dutch Ed Lane.  Motion carried unanimously.  Dennis Christensen moved, Keja Whiteman seconded, to approve a Standard Form of Agreement between Owner and Contractor with SDI Construction for the Fremont County Library – Carnegie Remodel.  Motion carried unanimously.  Dennis Christensen moved, Pat Hickerson seconded, to approve Fremont County Capital Revolving Fund Lease Memorandums for Sheriff (6 vehicles) and Transportation (Trailer, Dump Truck and Transport Truck).  Motion carried unanimously.

 

County Clerk Julie Freese stated Ambulance Director Lauri Wempen needs immediate authorization for her requested rate adjustment, presented to the Board during her budget hearing that includes a rate adjustment for increasing fuel costs and cost of inventory as follows:  ALS Non-Emergent to $625.00; ALS Emergent to $700.00; BLS Non-Emergent to $500.00; ALS2 to $1,200 and mileage to $10.40 per mile.  This flat rate reflects the base rate and disposable usage.  Currently, all disposables are an additional charge to the base rate.  Pat Hickerson moved, Travis Becker seconded, to approve the rate increase as recommended.  Voting against the motion: Doug Thompson.  Motion carried.

 

There being no further business, Travis Becker moved, Dennis Christensen seconded, to adjourn the meeting at 11:00 a.m. and reconvene at 5:30 p.m. on July 9, 2012 for a Public Hearing for the Fremont County Budget.  Motion carried unanimously.
