OFFICIAL MINUTES

 

The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present:  Chairman Travis Becker, Ray Price, Jennifer McCarty and Clarence Thomas.  Commissioner Allen joined the meeting later. Fremont County Clerk Julie A. Freese was present for the meeting.

 

Larry Allen moved, Jennifer McCarty seconded, to approve the Agenda as amended.  Motion carried unanimously.

 

Ray Price moved, Clarence Thomas seconded, to approve the Minutes of the Regular Meeting that was held on June 13 & 14, 2017.  Motion carried unanimously.

 

Ray Price moved, Clarence Thomas seconded, to accept the regular bills for payment.  Motion carried unanimously.

The following items in the Signature File were reviewed:  1) Memorandum of Understanding between University of Wyoming and Commissioners of Fremont County to conduct Extension educational programs  (taken under advisement pending discussion between UW and County Attorney’s Office); 2 ) Collection Agreement between Fremont County, Wyoming and the United States Department of Agriculture, US. Forest Service, Shoshone National Forest, for 2017 Flood Assistance (no action on the Agreement will be taken this year); and 3) Record of Proceedings.  Larry Allen moved, Ray Price seconded, to approve Licenses for New Construction of Utility Crossing or Encroachment from Rocky Mountain Power for North Smith Road, Riverton; Aethon Energy for Castle Gardens Road; and High Plains Power, Inc. for Country Garden Road.  Motion carried unanimously.  Larry Allen moved, Ray Price seconded, to approve an Application/Permit to Construct Access Driveway from Brett Freese on North 2nd Street.  Motion carried unanimously.  Larry Allen moved, Ray Price seconded, to approve a Blue Cross Blue Shield ASO Group Plan Change form.  Motion carried unanimously.  Larry Allen moved, Clarence Thomas seconded, to approve an Agreement for the Sale of Land from Courtney Dale Sexton and Fremont County for .82 acres for right-of-way for the Cooper Road project.  Motion carried unanimously.  Larry Allen moved, Ray Price seconded, to approve an End User Technical Services Agreement with Red Canary, Inc. for Managed Threat Detection Services.  Motion carried unanimously.  Larry Allen moved, Ray Price seconded, to approve a Fremont County Bank of the West Credit Card Application for Hattie Calvert with a credit limit of $2,500.  Motion carried unanimously.

 

The Public Comment period was held.

 

Treasurer Scott Harnsberger read from a prepared statement requesting the Board consider the decision to eliminate $19,835 from the Treasurer’s budget related to compensation given to the Deputy Treasurer and other staff within the Treasurer’s Office.    Ray Price moved to reinstate the bonus amount of $19,835 back into the Treasurer’s salary line item.  Motion died for lack of a second.  Following the failed vote, Harnsberger stated he plans to keep his obligation of attending the National Association of Counties meeting in July as one of Wyoming’s voting delegates; however, the Board could expect his resignation effective August 1st.

 

County Clerk Julie Freese and Financial Assistant Joe Felix presented a preliminary budget hearing.

 

Larry Allen moved, Ray Price seconded, to adjourn into Executive Session regarding personnel with Transportation Superintendent Dave Pendleton.  Motion carried unanimously.  Larry Allen moved, Ray Price seconded, to return to Regular Session.  Motion carried unanimously.

 

Transportation Superintendent Dave Pendleton reviewed the recent 1% Committee meeting held, and presented a Proposed New Projects One Percent Fund FYE 2018.

 

Dave Pendleton provided a history of the Burris-Lenore Road.

 

Dave Pendleton stated that to date, the most flood related issue has been Wilderness Road.

 

A Public Hearing was held at 10:00 a.m., as advertised, to discuss new legislation regarding Fremont County liquor licenses, specifically related to hours and days of operation.  Larry Allen moved, Ray Price seconded, to approve Resolution No. 2017-13 affirming Resolution 2001-02 “Setting Forth the Hours of Sale for all Liquor Licensees approved by the Board of Fremont County Commissioners”.  Motion carried unanimously.

 

Fremont County Planning Director Steve Baumann presented a proposed plat for Kummer Subdivision, a lot split of a current four acre parcel near the intersection of Mortimore Lane and Highway 789.    The split will allow for the sale of a towing business that is located on the property and separate it from the home on the parcel.  Per the Planning and Transportation Department, an access easement to Lot 1 through Lot 2 was added and the Planning Commission has recommended approval of the plat.  Ray Price moved, Larry Allen seconded, to approve Kummer Subdivision.  Motion carried unanimously.

 

Commissioner Meeting Reports were given:

 

The Wind River Visitor’s Council Joint Powers Board representative for Fremont County, Shannon Batenhorst, was joined by McCormick Marketing staff member Casey Adams, to review the proposed budget and operating plan, effective July 1, 2017.

 

Chairman Becker closed as the Board of Fremont County Commissioners and opened the Fremont County Board of Equalization.  Assessor Tara Berg and Deputy County Attorney Jodi Darrough reviewed a Motion to Dismiss in the Matter of the Protest of Sears Holdings, Docket No. 2017-02.  Assessor Deputies Angie Wilson and Mike Klaassen were present in the audience.  Three reasons were outlined in the Motion to Dismiss:  Protester has no Standing, Protester provided no Proof of Delegation and Statement of Appeal is Insufficient Pursuant to the Uniform County Board of Equalization Practice and Procedure Rules.  Berg distributed a Timeline of Appeal events, outlining the lack of response from Protestor after four failed attempts via phone, e-mail and mail.  Protester had also been informed of the hearing this date and had not followed up by phone or was not present in the audience.  Ray Price moved, Larry Allen seconded, to approve the Dismissal Order in the Matter of the Protest of Sears Holdings, Docket No. 2017-02.  Motion carried unanimously. Chairman Becker adjourned as the Fremont County Board of Equalization and returned to the Board of Fremont County Commissioners.

 

Commissioner Thomas was excused for personal reasons.

 

Interviews were held for the following County appointed Boards:

 

Cy Lee – requesting reappointment to the Wind River Visitor’s Council

Janet Hulbert-Young – requesting reappointment to the Fremont County Preservation Commission

Lois Herbst – requesting reappointment to the Fremont County Preservation Commission

Julia Stuble – new applicant requesting appointment to the Fremont County Historic Preservation Commission

 

Public Health Nurse Manager Kathleen Laidlaw stated budget cuts made the previous meeting to the Public Health budget are fine; however, they have received a small indirect federal grant from the Center for Disease Control specifically for the Immunization Program in the amount of $2,800 and she presented an amended budget with the change.

 

The Board adjourned for lunch to attend the second annual employee picnic in the Courtyard.  The event is hosted by the Fremont County Christmas Committee as part of their summer fun events.

 

Commissioner Thomas was present for the remainder of the meeting.

 

County Clerk Julie Freese reviewed her e-mail to the Departments following last week’s budget session where the Commissioners made cuts starting from a deficit of $2.155 million down to $1 million.

 

Commissioner Thomas requested County Clerk Julie Freese respond to the Treasurer’s written documentation presented earlier in the meeting, specifically regarding the COLA amounts.

 

BLM Field Manager Rick VanderVoet, Assistant Field Manager Bryan Curtis and Range Management Specialist Tim Cramer were present to review the Silver Creek Grazing Permit Renewal Public Scoping document published on April 20, 2017.  Present in the audience were Doug Thompson, Julia Stuble and Shane Sanderson.

 

Commissioner Ray Price was excused from the remainder of the meeting.

 

Larry Allen moved, Clarence Thomas seconded, to adjourn into Executive Session with Jim Massman and Julia Willoughby regarding personnel.  Motion carried unanimously.  Larry Allen moved, Jennifer McCarty seconded, to return to Regular Session.  Motion carried unanimously.

There being no further business, Larry Allen moved, Jennifer McCarty seconded, to adjourn the meeting at 5:30 p.m. and reconvene for a Special Meeting on June 26, 2017 at 5:30 p.m.  Motion carried unanimously.
