The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present: Chairman Travis Becker, Vice-Chairman Larry Allen, Jennifer McCarty and Clarence Thomas. Commissioner Ray Price was absent. Fremont County Clerk Julie A. Freese was present for the meeting.
Larry Allen moved, Jennifer McCarty seconded, to approve the Agenda as amended. Motion carried unanimously.
Larry Allen moved, Clarence Thomas seconded, to approve the minutes of the Regular Meeting held February 20, 2018. Motion carried unanimously.
Jennifer McCarty moved, Clarence Thomas seconded, to accept the regular bills for payment. Chairman Becker abstained from voting on The Print Shop voucher. Motion carried unanimously.

Clarence Thomas moved, Jennifer McCarty seconded, to accept a voucher from Wyoming Behavioral Institute in the amount of $4,317.00 for Title 25 patients. Motion carried unanimously.
The following items in the Signature File were reviewed: 1) sympathy cards; 2) Abatement Summary cover sheet; 3) Reply letter to BIA objecting to the application they received for the acquisition of land by the United States to be held in trust for the use and benefit of the Northern Arapaho Tribe; and 4) Record of Proceedings. Larry Allen moved, Jennifer McCarty seconded, to approve Findings of Fact and Proposed Plan of Dissolution and Liquidation Regarding Dissolution of a Special District in the Matter of the Dissolution of the Lucky 13 Special Water District. Motion carried unanimously. Larry Allen moved, Jennifer McCarty seconded, to approve Resolution No. 2018-11 “Declaring the Lucky 13 Special Water District Dissolved.” Motion carried unanimously. Larry Allen moved, Jennifer McCarty seconded, to approve an Agreement for Transfer of Land and Special Limited Warranty Deed from the Board of Commissioners of Fremont County, Wyoming to Jerry and Theresa Schroeder for 0.57 acres. Motion carried unanimously. Receipt of the amount of $351.26 was acknowledged. Larry Allen moved, Jennifer McCarty seconded, to approve Western Surety Company Official Bond and Oath for Jeffrey City Water & Sewer District directors Rebecca Ruth Darnell and Phillip R. Moody. Motion carried unanimously.
The following items in the Priority Mail were reviewed: 1) High Plains Power, Inc. proxy votes (forwarded to the next meeting); and 2) Fremont County Local Emergency Planning Committee meeting reminder for March 21st (Vice-Chairman Allen plans on attending).
There was nobody present for the public comment period.
Athletic trainers Adam Simon (CWC) and Paige Nolan (LVHS) requested the Board Proclaim March as National Athletic Training Month in Fremont County. Larry Allen moved, Jennifer McCarty seconded, to Proclaim March as National Athletic Training Month in Fremont County. Motion carried unanimously.
Riverton Mayor Lars Baker introduced the City’s new Administrator, Tony Tolstedt, to the Board.
Transportation Superintendent Dave Pendleton gave an update on the 1% fund gravel project by stating crews began hauling on South Muddy today.
Dave Pendleton stated the Riverton Crew was informed by the Sheriff’s Department over the weekend of major road damage in several spots on the Castle Gardens Road.
An update on the Dry Creek Road Realignment project was given and Dave Pendleton stated the AML is currently advertising for bids to reclaim the Rattlesnake quarry and crush the lower portion of the gravel needed for Dry Creek Road Improvement Project. The design plans for the project calls for proper drainage and reducing snow drifting issues.
James Gores and Associates, Inc., Engineer Eric Carr joined Dave Pendleton to provide an update on the Moneta-Lysite Road Shoulder Improvement project.
In closing, Dave Pendleton gave a budget update by stating there is a balance of $867,986 in the 1% fund and $1,266,000 in the Road Construction Fund, which includes anticipated revenue. A recent meeting with Tribal Transportation Planners and Commissioners was briefly reviewed, and Pendleton will send Eastern Shoshone Business Council Chairman Wagon the information on projects completed and planned for maintenance with 1% funding.
Fremont County Library Director Janette McMahon asked for approval to fill a 32-hour position at the Riverton Branch. Jennifer McCarty moved, Larry Allen seconded, to approve refilling the position. Motion carried unanimously.
County Clerk Julie Freese stated an amendment has been suggested by County Attorney Patrick LeBrun regarding the recently approved Employee Driving Record Policy. The suggested addition is “the County Clerk will ask for no more than the previous five years of driving records”. Clarence Thomas moved, Larry Allen seconded, to approve the amendment to the Employee Driving Record Policy. Motion carried unanimously.
In another matter, Julie Freese reviewed the Mileage Reimbursement Policy stating reimbursement is automatically $.30/mile if a personal vehicle is used and a county pool car is available. If no county car is available, reimbursement would be $.40/mile. Several Elected Officials had asked for an exemption for their employees that are either on-call or that daily go to the post office and/or bank. The Commissioners stated they would look into the possibility of providing a car to these departments to be used on a daily basis with no pool check out required. In the meantime, the Policy stands regarding mileage reimbursement rates.
Two bids were received from prospective tenants for rental of agricultural property located at 1249 Major Avenue, Riverton (approximately 105 acres). Chairman Becker took the bids under advisement and will prepare a side by side comparison for action at the following meeting.

A Public Hearing was held at 10:30 a.m., as advertised, regarding renewals of County Retail Liquor Licenses and County Malt Beverage Permits for the upcoming license year (April 15, 2018 – April 14, 2019). There was nobody present in the audience either for or against the issuance of the licenses. Sheriff Hornecker’s Office had submitted a letter stating that a review of the incident reports related to the establishments was taken and that there were no areas of concern with any of the establishments. The Alcohol Compliance checks for 2017 resulted in one warning and two citations. UW Extension Educator for the Northwest Region, Barton Stam, presented a Final Project Report entitled “Wyoming Livestock Predation Trends and Mitigation Survey”.
County Clerk Julie Freese stated the Official Voter Survey is still open until the end of the month.
Building Maintenance Supervisor JR Oakley provided an update on recent issues with the Dubois Ambulance house.
Larry Allen moved, Clarence Thomas seconded, to adjourn into Executive Session with Executive Health Insurance Committee members Margy Irvine and Julie Freese for personnel. Following completion of that session, the Board continued in Executive Session for potential litigation. County and Prosecuting Attorney Patrick LeBrun was present for both sessions. Larry Allen moved, Clarence Thomas seconded, to return to Regular Session. Motion carried unanimously.
There being no further business, Larry Allen moved, Clarence Thomas seconded, to adjourn the meeting at
11:45 a.m. and reconvene for a Regular Meeting on March 13, 2018 at 9:00 a.m. Motion carried unanimously.
