The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present:  Chairman Travis Becker, Vice-Chairman Larry Allen, Ray Price, Jennifer McCarty and Clarence Thomas.  Fremont County Clerk Julie A. Freese was present for the meeting.


Larry Allen moved, Jennifer McCarty seconded, to approve the Agenda as amended.  Motion carried unanimously.


Jennifer McCarty moved, Ray Price seconded, to approve the minutes of the Regular Meeting held on September 18, 2018.  Motion carried unanimously.


Jennifer McCarty moved, Ray Price seconded, to accept the bills for payment, with the exception of one for a state employee mileage rate reimbursement, pending clarification.  Motion carried unanimously.  Later in the meeting, Jennifer McCarty moved, Clarence Thomas seconded, to accept the travel voucher for the State employee at the State reimbursement rate.  Motion carried unanimously.

The following items in the Signature File were reviewed:  1) Conoco Phillips interest refund check in the amount of $13.02; 2) Abatement Summary cover sheet; and 3) Record of Proceedings.  Ray Price moved, Jennifer McCarty seconded, to approve the document required to register with the US Government through the online System for Award Management.  Motion carried unanimously.  Ray Price moved, Jennifer McCarty seconded, to accept the resignation of Fredrick Antelope to the Fremont County Historic Preservation Commission with regret.  Motion carried unanimously.  A letter of appreciation was subsequently approved.  Ray Price moved, Jennifer McCarty seconded, to approve an amended Agreement for Cooperation on Demolition for several unsafe and condemned buildings in the Town of Shoshoni.  Motion carried unanimously.  Ray Price moved, Jennifer McCarty seconded, to approve a Youth Services Agreement with the City of Riverton.  Motion carried unanimously.  Ray Price moved, Jennifer McCarty seconded, to ratify a FEMA Funded Repair Project Advertisement for Bids for Road Shoulder Repairs on Red Canyon Road.  Motion carried unanimously.  Ray Price moved, Jennifer McCarty seconded, to approve a termination letter to Magellan Rx Management, Inc.  Motion carried unanimously.  Ray Price moved, Jennifer McCarty seconded, to approve a grant attachment “Affirmation of Audit for FYE for the Court Assisted Supervised Treatment program.  Motion carried unanimously.  Ray Price moved, Jennifer McCarty seconded, to approve a License for New Construction of Utility Crossing or Encroachment from High Plans Power for Carpenter Road, Dubois Telephone Exchange for Warm Springs Road and RT Communications for Muskrat Road.  Motion carried unanimously.  Ray Price moved, Jennifer McCarty seconded, to approve an Application/Permit to construct Access Driveway from Paul Butler for Union Pass Road.  Motion carried unanimously.


The following items in the Priority Mail were addressed:  1) second review of Teton County Commissioners’ request to begin a dialog about a statewide and/or regional disposal plan for wildlife carcasses due to the expanding threat Chronic Wasting Disease poses.  The Fremont County Solid Waste District is not interested in discussion as relayed by Commissioner McCarty and board member Steve Baumann.  Commissioner Thomas will draft a letter to Teton County stating Fremont County is not interested in discussing a joint venture.  2) FEMA letter regarding final request for information on pending first appeal regarding activities prior to May 31, 2017.  Chairman Becker and Vice-Chairman Allen participated in a conference call the previous week with Office of Homeland Security personnel regarding FEMA’s request for additional documentation.  Commissioner Allen recommended Emergency Management Coordinator Kathi Metzler attempt one more time to submit additional information to hopefully answer FEMA’s questions.


Representative Lloyd Larsen was present to address several Wyoming Office of State Lands and Investments documents:  Easement Application and Temporary Use Permit for Wyoming Department of Health on their Life Resource Center land for a new disposal site which will store demolition debris including asbestos containing materials, lead-based paint, and other contaminated soils, consisting of up to two acres.


The Public Comment period was held.


Fremont County and Prosecuting Attorney Patrick LeBrun stated he will have a vacancy in his office for an attorney effective December 7th.  He will not be looking for an entry level position and recommended offering the current salary of $77,000.  Ray Price moved, Jennifer McCarty seconded, to authorize refilling an Attorney position at the salary rate of $77,000.  Motion carried unanimously.


Lander Road Crew Chief Clyde Winchester and Administrative Secretary Jill Johnson provided a department update


Ray Price moved, Jennifer McCarty seconded, to adjourn into Executive Session with Justice Services Director Melinda Cox regarding personnel.  Motion carried unanimously.  Ray Price moved, Jennifer McCarty seconded, to return to Regular Session.  Motion carried unanimously.


Ray Price moved, Jennifer McCarty seconded, to adjourn into Executive Session with Owl Creek Engineering PE Harry E. Hughes, counsel for Mountain Construction Company, for potential litigation.  Motion carried unanimously.  Following the session, the Board remained in Executive Session regarding personnel.  Larry Allen moved, Ray Price seconded, to return to Regular Session.  Motion carried unanimously.


County Clerk Julie Freese asked the Commission to consider an amendment to the Personnel Policy regarding Jury Duty.  In another matter, she stated that timing delays on the purchase of the Coroner’s pickup truck has caused the need for an additional $2,000 authorization for the total purchase of $35,000 from the Capital Revolving Fund.  Jennifer McCarty moved, Ray Price seconded, to authorize the additional amount for a final authorization of $35,000.  Motion carried unanimously.


Commissioner meeting reports were given.


There being no further business, Larry Allen moved, Clarence Thomas seconded, to adjourn the meeting at 12:10 p.m. and reconvene for a Regular Meeting on October 9, 2018.  Motion carried unanimously.
