<p>The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present: Chairman Douglas L. Thompson, Vice-Chairman Pat Hickerson, Keja Whiteman, Dennis Heckart and Dennis Christensen.  County Clerk and Clerk of the Board Julie A. Freese was present.</p>
<p>Dennis Heckart moved, Dennis Christensen seconded, to accept the Agenda as amended.  Motion carried unanimously.</p>
<p>Pat Hickerson moved, Dennis Heckart seconded, to approve the Minutes of the June 29, 2010 meeting, as amended.  Motion carried unanimously.</p>
<p>Dennis Heckart moved, Dennis Christensen seconded, to accept the bills for payment.  Motion carried unanimously.  County Clerk Julie Freese will send out an e-mail to all departments regarding any uniform policy they may have for the Board’s information.</p>

<p>Keja Whiteman moved, Dennis Christensen seconded, to approve a Regional Economics Models, Inc. Software Licensing Agreement.  Motion carried unanimously.  Chairman Thompson stated Ryan Lance of the Governor’s Office has stated there is funding to reimburse the county for the costs.  The software will set an economic baseline for Fremont County which will be useful for the BLM Plan Revision process.  When other counties come on board, the state will maintain the software instead of individual counties.</p>
<p>Keja Whiteman moved, Dennis Heckart seconded, to adjourn into the Board of Equalization.  Motion carried unanimously.  Keja Whiteman moved, Dennis Heckart seconded, to dismiss a Board of Equalization Tax Protest filed by CM Ranch, LLC (Docket No. 2010-20) as the protest has been withdrawn by petitioner.  Motion carried unanimously.  Dennis Christensen moved, Dennis Heckart seconded, to return to Regular Session.  Motion carried unanimously.</p>
<p>The Board reviewed a letter from Diana Mitchell expressing interest in being re-appointed to a term on the Fremont County Historic Preservation Commission.  Pat Hickerson moved, Dennis Heckart seconded, to re-appoint Dianna Mitchell to a three year term.  Motion carried unanimously.</p>

<p>RESOLUTION  2010-21</p>
<p><strong>A RESOLUTION FOR THE ACCEPTANCE OF ROADWAYS ON FEDERAL PUBLIC LANDS AS PUBLIC COUNTY HIGHWAYS</strong></p>
<p>WITNESSETH</p>
<p><strong>WHEREAS</strong>, The State of Wyoming Legislature passed SF0040 – Establishment of Highways; and</p>
<p><strong>WHEREAS</strong>, SF0040 was signed into law by acting Governor Freudenthal; and</p>
<p> <strong>WHEREAS</strong>, SF0040 amended Title 24 Highways, W.S. 24-1-101. Public Highways defined and established; and</p>
<p> <strong>WHEREAS</strong>, the amendment signed into law states: “No other roads, except roads located on federal public lands prior to October, 1976 which provide access for a private residence or agricultural operation shall be highways upon acceptance by the board of county commissioners of the county where the road is located shall be highways unless and until lawfully established as such by official authority.”; and</p>
<p><strong>WHEREAS</strong>, the Fremont County Transportation Department and County Clerk have in their possession a set of eight (8) maps entitled: “GENERAL HIGHWAY MAP, FREMONT COUNTY WYOMING, PREPARED BY THE WYOMING HIGHWAY DEPARTMENT, PLANNING DIVISION, IN COOPERATION WITH THE, U.S. DEPARTMENT OF TRANSPORATION, FEDERAL HIGHWAY ADMINISTRATION, 1972, APPROVED APRIL 30, 1973” that will serve as a substantial portion of the documents that identify those highways in existence prior to October, 1976; and</p>
<p><strong>NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY</strong> of Fremont County, that it recognizes the need for acceptance of said highways for private residential and agricultural operation purposes in addition to commercial, industrial and public access; and</p>
<p><strong>BE IT FURTHER RESOLVED </strong>that the governing body of Fremont County accepts all highways on federal public lands identified on those and other yet to be identified maps as county highways open for use by the public under the authority and control of the Board of Fremont County Commissioners.</p>

<p>Transportation Superintendent Dave Pendleton reviewed costs previously distributed regarding estimate of probable project costs for bridge replacements due to the 2010 flood, totaling $4,723,000 for Middle Fork Popo Agie Bridge – Mortimore Lane ($1,043,000); Little Wind River Bridge – 17 Mile Road ($3,320,000); Popo Agie Ranch Estates Road Repair and Bridge Replacement ($230,000) and North Fork Road Damage Repair ($130,000).  He stated FEMA funding should cover 75% of the costs with the County responsible for the remaining 25%, which can include cost share.  He further stated that the North Fork Road repair on the Reservation could qualify for IRR funding.  The Commissioners stated they still plan to send a letter to Governor Freudenthal to request a disaster declaration for agricultural purposes.  They requested Pendleton compile a detailed list of all expenditures incurred during the flood for the declaration request to include overtime, equipment costs, materials, etc.   Pendleton reviewed a Road Construct Fund Budget Summary indicating a fund balance beginning FY 2012 of $1,114,994. </p>
<p>Dave Pendleton stated WYDOT will open bids on July 13<sup>th</sup> for the 17 Mile Bridge project and award the contract on July 15<sup>th</sup>.  He stated the contractor would then begin around August 1<sup>st</sup> on the detour portion of the project.  Commissioner Whiteman asked Pendleton to see if this could be expedited in any way as school will begin around August 1<sup>st</sup> and, until the detour is completed, will create hardships for school children.  Pendleton stated that $17,123 worth of cable was purchased to remove the Mortimore Lane bridge and cannot be returned, as earlier thought and he was authorized to sell the cable.  In closing, Pendleton has reviewed the two WYDOT Contracts for safety improvements on Baldwin Creek Road and stated they should be returned to WYDOT to begin the process.</p>
<p>Planning Department Administrative Secretary Koni Gilgen presented a re-plat of Lots 4 and 5, High Country Estates Subdivision.  This plat is a lot line adjustment between the two lots in the Union Pass subdivision.  It was recommended for approval by the Planning Commission pending a change from “resubdivision” to “replat” on the plat, which has been done.  Dennis Heckart moved, Dennis Christensen seconded, to approve the re-plat as presented.  Motion carried unanimously.</p>
<p>A plat for the resubdivision of Lot 3, Kasper Subdivision, was reviewed.  This subdivision is located off of Delfelder Road just south of Young Road near Riverton.  The City of Riverton has given their approval for the resubdivision and the Planning Commission approved it as well.  Dennis Heckart moved, Keja Whiteman seconded, to approve the resubdivision. Motion carried unanimously.</p>
<p>Hudson Mayor Jake Hamon resumed discussion regarding a county loan to help with clean up as a result of the flood.  He is not sure how FEMA reimbursements will work and the Town is in need of immediate funding for equipment, etc.  The County Attorney’s Office had issued their recommendation that the County could not loan money to the Town.  Commissioner Whiteman had to leave the meeting to participate in a conference call but reiterated her desire to work out some solution to be able to assist the Town.  Treasurer Harnsberger was present in the audience for the discussion.  The Board discussed the allocation they had budgeted for the Fremont County Association of Government’s in the amount of $200,000, which is distributed to cities and towns via that board.  Pat Hickerson moved, Dennis Christensen seconded, to reduce the allocation to FCAG to $150,000 and fund the other $50,000 to the Town of Hudson for flood damage mitigation.  Voting against the motion: Dennis Heckart.  Motion carried.  In a related matter, Mayor Hamon asked the Board to contact a citizen regarding a ditch and fence issue as related to the flood event.</p>
<p> Vehicle Maintenance Supervisor Glen Steers gave a six month review of the Pool Vehicle Procedure policy.  The scheduling of the vehicles through his department seems to be working well, with back ups in different offices if needed.  He did ask that the Board inform the departments that there are now car wash cards for both businesses on the pool vehicle key rings.  He also wanted them to know of his concern that vehicles are being returned dirty and asked that care be given to return them in a clean condition, both inside and out.</p>
<p>Sheriff Hornecker joined the meeting to express concern over the cuts made to his budget ($80,000 in Detention and $70,000 in Sheriff Administration/Patrol) over and above that which he turned back in his fund balance.  Present in the audience was Carl Freeman and Jesse Lyles.  Sheriff Hornecker stated there is no way he could make these cuts without cutting staff.  Vice-Chairman Hickerson, who was acting chairman the previous week when the cuts were made, attempted to explain the Board’s reasoning behind the cuts, of which generally amounted to 2% per budget for most departments.  Cash reserve for the upcoming two years as well as large flood related costs were part of the Board’s reasoning when making the cuts the previous week.  Other reasons included funding the Wyoming Retirement Benefit 100% as well as splitting the increase in costs for the health insurance plan.</p>
<p>The annual review of the Death Benefit Plan was reviewed.  The beneficiary of a full time employee is entitled to receive the total sum of $10,000 and the part time employee beneficiary received $5,000.  Dennis Heckart moved, Dennis Christensen seconded, to renewal the Death Benefit Plan for FY 2010-11 with funding through the Health Benefit Fund.  Motion carried unanimously.</p>

<p>Vice-Chairman Hickerson reported on the Solid Waste Disposal Board meeting and stated they had hired a new engineering firm to work on permit issues on a case by case basis.  He is still working on a contract with the Lander Valley Medical Center and Pine Ridge regarding Title 25 patients.</p>
<p>Chairman Thompson distributed copies of the Wyoming Sage Grouse Implementation Team’s report to Governor Freudenthal.  He will also draft a letter to the Lander DEQ for an update on the investigation on the Riverton former tie treating plant as related to a potential land swap the County is working on.</p>
<p>County Clerk Julie Freese will send a letter to special districts asking them to adhere to the same requirement of County employees regarding paying for health insurance premiums.  She will also work with the Board and County Attorney regarding setting up public meetings to review the election redistricting plan proposed by the County.</p>
<p>There being no further business, Dennis Heckart moved, Dennis Christensen seconded, to adjourn the meeting at 12:00 p.m. and reconvene on July 12, 2010 for a special meeting.  Motion carried unanimously. </p>

<p>The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present: Vice-Chairman Pat Hickerson, Keja Whiteman, Dennis Heckart and Dennis Christensen.  Chairman Thompson was absent.  County Clerk and Clerk of the Board Julie A. Freese was present.</p>
<p>Dennis Heckart moved, Dennis Christensen seconded, to accept the Agenda as amended.  Motion carried unanimously.</p>
<p> Dennis Christensen moved, Dennis Heckart seconded, to approve the Minutes of the June 22, 2010 meeting.  Motion carried unanimously.</p>
<p>Dennis Heckart moved, Keja Whiteman seconded, to accept the bills for payment.  Motion carried unanimously.  Vice-Chairman Hickerson stated there are several items that can be returned for refund as related to the flood mitigation process.  He further stated several vouchers need to be discussed with the Sheriff’s Department.  The County Clerk will follow up on those discussions.</p>

<p>The following items in the Signature File were reviewed:  1) Regional Economic Models, Inc. Software Licensing Agreement (postponed until the following meeting); 2) Adjustment to Assessment Summary; and 3)  Commissioners Bond for Rebecca Darnell for a term on the Jeffrey City Water &amp; Sewer District.  Dennis Heckart moved, Keja Whiteman seconded, to approve a WYDOT contract for safety funding for Baldwin Creek Road pending review by the County Attorney and Transportation Superintendent.  Motion carried unanimously.</p>
<p>Fremont County Juvenile Treatment Court Coordinator Lora Davidson briefly joined the meeting to discuss an earlier request to temporarily raise their Department credit card limit to $5,000.  She noted the request is no longer need at this time and the minimum amount is adequate. </p>
<p>A MOU with the State Public Defender’s Office for the Guardian Ad Litem program will be forwarded to the following meeting pending budgetary issues.  A Freedom of Information Act request submitted to the Bureau of Land Management will also be forwarded to the following meeting.</p>
<p>Commissioner Heckart stated his belief that Payroll Status Changes submitted by the Treasurer’s Department were not appropriate and stated it creates inequities and morale issues within Fremont County.</p>
<p>Vehicle Maintenance Supervisor Glen Steers reviewed the status of the Wyoming Department of Transportation fuel bids and stated the low bidder was Bailey Oil Company.  Owner Mike Bailey was present in the audience.  Steers stated the current year fuel bid was in conjunction with the Wyoming Department of Transportation’s selection and next year’s low bid was Bailey’s as well.  The only increase is transportation to various county locations.  The bids were sent statewide.  Dennis Heckart moved, Dennis Christensen seconded, to approve a Fuel Service Contract with Bailey Enterprises, Inc. Bailey Oil Company for July 1, 2010 through June 30, 2011.  Motion carried unanimously.  Bailey noted the County will continue to receive a one-cent-per-gallon discount if they choose to continue to pay bi-monthly.</p>
<p>Commissioner Heckart took the opportunity to announce that he would not be seeking re-election to another term. Commissioner Heckart stated he wanted to announce at this time in order to give other individuals a chance to consider running for an open seat and not against an incumbent.  Heckart cited various reasons for his frustration and does not want to continue if he cannot give 100%.</p>
<p>The Board adjourned into the Board of Equalization.  Hearing Officer Terry Martin was present to hear the County BOE’s review of the John Wirth, Jr., (Docket No. 2009-12) protest hearing held the previous meeting.  Discussion was held regarding the evidence heard during that meeting.  Dennis Heckart moved, Dennis Christensen seconded, to vote in favor of the County Assessor’s assessment on said property.  Voting against the motion: Keja Whiteman.  Motion carried.</p>
<p>In other business, Dennis Heckart moved, Keja Whiteman seconded, to approve Dismissal Orders for Mike and Michaela Dabich (Docket No. 2010-18); Wirth Revocable Trust (Docket No. 2010-29); and Dickinson Living Trust (Docket No. 2010-13) as the taxpayers had each withdrawn their protest.  Motion carried unanimously.</p>
<p>The Board adjourned as the Board of Equalization and returned to Regular Session.</p>
<p>Hudson Mayor Jake Hamon requested financial assistance from the County (while waiting for potential FEMA funding) for clean up efforts associated with last month’s flood.  Thousands of sandbags were placed around homes threatened by flooding and part of the clean up plan would involve removing the sandbags and reinforcing embankments to mitigate future flood damage.  Hamon stated the Town does not have equipment or manpower to move that material.  He also stated other work includes resurfacing two streets and replacing several culverts.  He asked if they could have a line of credit from the County between $80,000 &#8211; $100,000 until they receive FEMA funding under a disaster declaration from President Obama, at which time the loan would be repaid.  Treasurer Scott Harnsberger was present for the discussion and volunteered to look into the legality of extending the line of credit to a non county entity with the County Attorney’s Office.  Vice-Chairman Hickerson also stated there may be emergency funding available through the State Lands and Investments Board as well. The Board was unanimously supportive of helping the Town with assistance and Mayor Hamon will return the following meeting after the County has had a change to review the issues.</p>
<p>A Budget Hearing was held at 10:00 a.m., as advertised, regarding Unanticipated Revenues and Budget Transfers.  Present was County Clerk Julie Freese and Financial Assistant Mike Stalder along with Treasurer Scott Harnsberger and Deputy Jim Massman.  Dennis Heckart moved, Keja Whiteman seconded, to approve Resolution No. 2010-20.  Motion carried unanimously. </p>

<p>Executive Health Committee members Jim Massman, Margy Irvine, Kristi Green and John Applegate were present to review several issues.  Irvine reviewed the Health Promotion by stating the County Health Plan spent $3.5 million in health care claims in Fiscal Year 2009 and they expect to reach $3.9 million in 2010.  The budget request for the Health Plan included $70,000 for a health promotion program.  This program will improve employee health, reduce health care costs, reduce employee absenteeism and increase employee productivity.  The new third party administrator (Employee Benefit Management Services) offers a Health Impact Program that provides disease management services and health promotion services and the Committee feels EBMS has the ability to coordinate these services with claims processing services to create an effective and efficient program.  The Committee further recommended names for a core group of employees to develop, coordinate and promote these programs on site.  Dennis Christensen moved, Dennis Heckart seconded, to accept the Committee’s recommendations to include disease management services, effective July 1, 2010, and wellness promotion, effective January 1, in the County’s administrative services agreement and to further appoint Matt Jacobson, Mike Deyo, Melinda Cox, Rebecca Thomas, Cora Gist, Leonard Hinkle and Kelly Conroy as the County’s Health Champion committee.  Motion carried unanimously.</p>
<p>The Executive Health Committee reviewed the Mental Health Parity and Addiction Equity Act that the Board declined on March 23<sup>rd</sup>.  They have since learned that Fremont County may opt out of the provisions of mental health parity requirements, thereby maintaining the current limited coverage for mental health and substance abuse treatment.  The health plan cannot provide coverage for common prescriptions to treat mental health issues without either opting our or extending coverage to mirror primary medical benefits.  The Committee believes that failing to cover these medications will have a significant negative impact on County employees and their covered family members.  To opt out Fremont County must file an election with Centers for Medicare &amp; Medicaid Services before July 1<sup>st</sup> and notify all enrollees that we have opted out of mental health parity requirements.  Keja Whiteman moved, Dennis Heckart seconded, to accept the Executive Health Committee’s recommendation to opt out of the mental health parity requirements and continue limited coverage as provided in the County’s current plan document.  Motion carried unanimously.  Vice-Chairman Hickerson signed the letter to Centers for Medicare &amp; Medicaid Services as required and the Notice to Enrollees in the Fremont County Group Health Plan was further approved.</p>
<p>The Fremont County Health Benefit Plan Third Party Administrator received quotes from three stop loss carriers and the Executive Health Committee analyzed various proposals.  They also considered the merits of purchasing aggregate coverage.  At a cost of $13,200 they can limit the program’s risk to a loss of $1.4 million which could otherwise exceed that amount.  Dennis Heckart moved, Keja Whiteman seconded, to accept the stop loss proposal from Nationwide Mutual Insurance Company with a $125,000 specific deductible and aggregate coverage at an estimated annual cost of $283,000.  Motion carried unanimously.</p>
<p>In final business, the County Attorney’s Office reviewed the draft copy of the Business Associate Agreement with Employee Benefit Management Services to be the Fremont County Health Plan Third Party Administrator.  Dennis Heckart moved, Keja Whiteman seconded, to approve the Business Associate Agreement and have Vice-Chairman Hickerson sign the original document when it is received later in the week.  Motion carried unanimously.</p>
<p>Court Assisted Supervised Treatment Coordinator Melinda Cox briefly reviewed research and statistics on the program.  She continued discussion regarding office space needs and, along with Building Maintenance Supervisor J.R. Oakley, reviewed suggestions.  She recommended freeing up two of her offices in exchange for the current WIC office space and then moving her administrative offices upstairs to the two vacant offices.  One of these offices could be shared with the Museum Board when needed.  Keja Whiteman moved, Dennis Heckart seconded, to approve said changes, pending approval of the new WIC supervisor.  Motion carried unanimously.  Cox stated that the Family Planning Office would continue their monthly arrangement with WIC in the new location.  Cox further discussed office space suggestions for the Riverton office.  One room is currently being used for Riverton Museum storage and Oakley is looking at other storage alternatives for the Museum.  This would in turn free up office space for the CAST program office in Riverton.  Oakley will report back once he has researched the alternatives and provide a written proposal for associated costs.</p>
<p>In other business, Melinda Cox stated that for the CAST program to be a certified treatment facility there needs to be two separate job descriptions, one as director as well as one for program coordinator.  She will work on the job descriptions for herself as well as for her employees.  Even though they have two descriptions, only one salary will be paid.  Dennis Heckart moved, Keja Whiteman seconded, to appoint Melinda Cox as Director of CAST and also as coordinator of the program.  Motion carried unanimously.</p>

Oakley reviewed Amendment Number One to Contract between the Wyoming Business Council, Business and Industry Division, State Energy Office and Fremont County.  The current contract will expire June 30<sup>th</sup>.  Signing the Amendment will not commit the County in the future if they determine they do not wish to proceed.  The entities involved in the energy audit have met and most of them are going out on their own.  Keja Whiteman moved, Dennis Heckart seconded, to approve the Amendment.  Voting against the motion: Pat Hickerson.  Motion carried.</p>
<p>Juvenile Treatment Court Coordinator Lora Davidson joined County Clerk Julie Freese and Financial Assistant Mike Stalder to discuss the proper process to purchase two program vehicles through grant funding.  Keja Whiteman moved, Dennis Heckart seconded, to make a one time transfer to Capital Revolving Fund for the Juvenile Treatment Court program vehicles.  Motion carried unanimously.</p>
<p>County Clerk Julie Freese reviewed the most updated budget based on an assessed valuation of $762,677,435.  The budget currently has the health insurance increases and Wyoming Retirement increases included in each budget.  Since the flood, however, Freese noted that she will have to refigure the fund balance carryover due to the fact that funds were transferred from the cash reserve to several departments.  The only other changes she discussed was that she would like to recommend a temporary employee to help with elections since it is now evident that there will be at least 2 more elections than the regular Primary and General this year due to the ACLU lawsuit.   The cost of that person would be $14,000.</p>
<p>Discussion ensued regarding the flood, possible reimbursements and the required 25% match for FEMA reimbursements.  The Clerk was directed to contact Transportation Superintendent Dave Pendleton and ask him to give them a ballpark cost on bridge repairs, replacements, and road repairs, etc. and how soon some of those would need to be completed as well as potential funding possibilities.</p>
<p>The Fair capital projects were not completed this year.  Mike Stalder is working with them to get the figures so that they can be carried over to next year’s fiscal budget.</p>
<p>Indigent costs includes the agreement that each hospital has with the county to pay their property taxes in indigent care costs.  Also included in that budget is money for two potential indigent burials.</p>
<p>The assessed valuation was discussed with the Clerk and Treasurer and the amount will likely be about the same as this year’s valuation.</p>
<p>The commissioners discussed the current $2.0 million in reserves (over and above the $7.5 hospital reserve).  It was determined that they would like to have an additional $500,000 to add to that figure so that the other $2.5 million (of the $5 million saved in FY 09-10) could be used over two years instead of in one year. </p>
<p>Commissioner Whiteman recommended that they start the cuts by cutting the Commissioner’s budget by $7500 ($5000 in contractual services and $2500 in travel).</p>
<p>The Election budget was approved with the addition of the temporary person for election season.</p>
<p>The County Attorney’s budget was discussed as the only budget where an addition of one new attorney and part time secretary was approved.  A majority of the commissioners continued to agree with the caseload they are handling, they should be granted these positions, however, they cut the budget $26,000. </p>
<p>The Sheriff’s Administration/Patrol budget was cut $70,000.  Dispatch was cut only by health insurance costs.  The replacement employee line items all had family coverage listed and these were cut to single amounts.  Detention was cut $80,000. </p>
<p>The Public Defender budget had previously been cut in the rental line item to reflect whether a defender was full or part time.  If a defender was one-half time, they would only receive $300/month which is half of that rental fee.  The question that still remains is why the county has to pay for two attorneys who are housed in the public defender’s office.  The Clerk was asked to pursue whether they could cut that fee in half.</p>
<p>The Transportation Department budget was cut $100,000.  Information Systems was cut $10,000.  Buildings (courthouse) were cut $20,000 and Buildings (Detention) was cut $8,600.  Vehicle Maintenance was cut $20,000.  Planning was cut $6,300.</p>
<p>The Library budget was cut $50,000.  The Museum budget was cut $14,000.  The Fair budget was cut $20,000.  The Recreation Board was cut $10,000.</p>
<p>Statutory Medical costs were discussed and eventually were cut to $300,000 from $350,000.  The Clerk will work with the Attorney to review the current fiscal year’s budget in this area and work on a projection for next year.  The Predator District Board had indicated that their budget would be ok this year, so they were cut $2,000 bringing their total to $3,000.  Fremont Counseling was cut another $5,000 bringing them to a total of $10,000 from $25,000.  The Lower Wind River Conservation District was cut another $5,000 bringing them to $10,000 from their original $30,000 request.  The Fremont County Alcohol Crisis Center was cut $5,000 bringing their total down to $95,000 from $100,000.</p>
<p>The Clerk will double check all health insurance and Wyoming Retirement figures and advertise the proposed fiscal year 2010-2011 budget.  The Public Hearing will be held on July 12, 2010 at 5:30 p.m. in the County Commissioner’s Chambers with the final adoption to follow at the Commissioner’s meeting on July 13, 2010.</p>
<p>Vice-Chairman Hickerson updated the Board on the pending contract with Lander Valley Medical Center for Title 25 patients.  He will discuss the issue more at the next meeting.</p>
<p>Commissioner Christensen has received concerns via petitions regarding mag chloride treatments in the Pavillion area.  Riverton Crew Chief McWilliams informed him that these roads are not on the schedule for the upcoming year.  Commissioner Christensen will also work on getting an economic analysis on expenditures vs. savings of the treatment.</p>
<p>There being no further business, Dennis Heckart moved, Keja Whiteman seconded, to adjourn the meeting at 4:00 p.m. and reconvene on July 6, 2010 for a regular meeting.  Motion carried unanimously. </p>

<p>The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present: Chairman Douglas L. Thompson, Vice-Chairman Pat Hickerson, Keja Whiteman, Dennis Heckart and Dennis Christensen.   Also present was Deputy County Clerk Becky Enos.  County Clerk and Clerk of the Board Julie A. Freese was absent for personal reasons.</p>
<p>Dennis Christensen moved, Dennis Heckart seconded, to accept the Agenda as amended.  Motion carried unanimously.</p>
<p>Dennis Heckart moved, Dennis Christensen seconded, to approve the Minutes of the June 8, 2010 meeting.  Abstaining from the motion due to their absence from all or a portion of the meeting was Keja Whiteman and Pat Hickerson.  Motion carried.</p>
<p>Dennis Heckart moved, Pat Hickerson seconded, to accept the bills for payment, pending signatures on several vouchers.  Motion carried unanimously.  Several flood related expense vouches will not be paid until a budget hearing is held later in the meeting.</p>

<p>Fremont County Capital Revolving Fund Lease Memorandums were reviewed as follows:  Transportation Department for Water Tanker Plumbing; Dubois Museum for Cabin Move and Repair; Health Nurse, Agriculture Department and County Commissioners for one copier each.  Pat Hickerson moved, Keja Whiteman seconded, to approve the Lease Memorandums as presented.  Motion carried unanimously.</p>
<p>Dennis Christensen moved, Dennis Heckart seconded, to approve the Ambulance Director’s recommendation to write off $5,069.75 for services to inmates incarcerated at the Fremont County Detention facility.  Motion carried unanimously. </p>
<p>A 24-Hour Malt Beverage Permit request submitted by the 1838 Rendezvous Association was reviewed for the annual re-enactment to be held June 30-July 4, 2010.  Dennis Christensen moved, Dennis Heckart seconded, to approve the 24-Hour Malt Beverage Permit as presented.  Motion carried unanimously.  Receipt of the $125 fee was acknowledged.</p>
<p>Two maps were reviewed of various portions of Smith Road in which the landowners are wishing to deed their portion of the Road to Fremont County.  The Board stated they would have Transportation Superintendent Dave Pendleton research the offers and procedures and report back.</p>
<p>Commissioner Christensen acknowledged receipt of several Irrigation Assessment Rolls for the year 2010 as follows:  Mountain View Water and Sewer District, Midvale Irrigation District and Riverton Valley Irrigation District.</p>
<p>Farm Services Agency County Executive Director Andrea Warren was present to inform the Commissioners of funding opportunities available through FSA for damages as a result of the recent flooding in Fremont County.  She sated the Governor’s Flood Declaration already done does not open up funding for agriculture related damages.  A U.S. Secretary of Agriculture Declaration must be made in order to open up federal funding for these damages and a written request must be made to the Governor within three months. This Emergency Loan Program is for farmers and ranchers who own or operate land located in a county declared by the President as a disaster area or designated by the Secretary of Agriculture and are for physical losses only.  Several of the Commissioners recommended the request to made to the Governor immediately and now wait for an assessment of loss.  Pat Hickerson moved, Keja Whiteman seconded, to send a joint letter with both the Shoshone and Arapaho Tribes to Governor Freudenthal to request a U.S. Secretary of Agriculture Disaster Declaration.  Motion carried unanimously. FSA does currently have an Emergency Conservation Program that provides emergency funding and technical assistance for farmers and ranchers to rehabilitate farmland damaged by natural disasters at a 50% &#8211; 75% cost share.  Farmers and ranchers do need to sign up for the program before they begin repairs on irrigation systems, ditches, fences, etc.  This funding is appropriated by Congress. </p>
<p>Transportation Superintendent Dave Pendleton distributed photos of the damage to 17 Mile Bridge and also a draft Agenda of the Tribal Transportation Cooperative Meeting to be held in Thermopolis on July 28<sup>th</sup>.  The Commissioners request he draft a letter to Wyoming Department of Transportation for their signature requesting assistance for providing and installing an ACROW bridge across the Little Wind River on 17 Mile Road to serve as a temporary detour until a new replacement bridge can be constructed.</p>
<p>Dave Pendleton stated the Presidential Disaster Declaration will enable 70% funding assistance for Fremont County.  He presented the following estimates of damages which have already been reported to FEMA:  Middle Fork Popo Agie Bridge – Mortimore Lane ($1,043,000); Little Wind River Bridge – 17 Mile Road ($3,320,000); Popo Agie Ranch Estates Road Repair and Bridge Replacement ($230,000) and North Fork Road Damage Repairs ($130,000) for total estimated Fremont County Road and Bridge Damages of $4,723,000.  Pendleton noted these estimates do not include damages caused to other structures resulting from scour.  That information will not be available until a later date due to continuing high water.  Pendleton further stated County road crews did an outstanding job during the flood mitigation and logged many overtime hours.  Private contractors were also a major help.  He estimated 50,000 volunteer hours and the assistance of over 400 National Guard personnel.  There are 100 pallets of sandbags at the Riverton Fairgrounds which is available for the public.  If prior arrangements are made, a loader can be made available to load pallets onto trailers.  The Commissioners thanked Commissioner Hickerson for his efforts during the past week and he in turn thanked the numerous other individuals and agencies that came to Fremont County’s aid.  Chairman Thompson stated he would like a debriefing at some point in the future.</p>
<p>Dave Pendleton presented a revised plat for Polson Subdivision sewer line improvements.  He stated the landowner has revised his earlier plat and the City of Riverton has now approved the revision.  Pat Hickerson moved, Dennis Christensen seconded, to approve the revised plat for Polson Subdivision.  Motion carried unanimously.</p>
<p>Commissioner Whiteman asked Dave Pendleton for an update on Sharpnose Bridge as she has been getting numerous calls regarding the status.  He stated that Bornhoft Construction had received the bid on the project and would get her updated information.</p>
<p>Pat Hickerson moved, Keja Whiteman seconded, to adjourn into Executive Session with Patti Trautman regarding personnel.  Motion carried unanimously.  Keja Whiteman moved, Dennis Christensen seconded, to return to Regular Session.  Motion carried unanimously.  No action was taken.</p>

<p>A tax protest hearing was held for John Wirth, Jr. (Docket No. 2009-12) as postponed from 2009 pending a District Court decision in a civil case filed by Wirth to compel the County Assessor to provide additional sales information.  District Court (Civil No. 37043) rendered its decision on March 19, 2010 stating that Petitioner is entitled to statements of consideration actually used by the assessor in valuing his property and no additional statements of consideration and that he is only entitled to the discovery of the syntax data only to the extent it was relied upon by the Assessor.  As a result, the hearing was set this date to review the 2009 protest of property valuation.  Present was Hearing Examiner Terrance Martin, Taxpayer John Wirth, Jr. and Counsel Phil Nicholas, County Assessor Eileen Oakley, Deputy Tara Berg and Counsel Jodi Darrough.  The tax protest hearing concluded at 4:20 p.m. and the Board of Equalization will deliberate on the case during their following meeting and render their decision.</p>

<p><strong>RESOLUTION 2010-18</strong></p>
<p><strong>REMEDIAL VOTING PLAN, ALTERNATIVE PLAN,</strong></p>
<p><strong>AND SPECIAL ELECTION SCHEDULE</strong></p>
<p><strong>                WHEREAS,  </strong>The United States District Court for the District of Wyoming has ruled that the voting system used in Fremont County violates Section 2 of the Voter Rights Act, as amended; and</p>
<p>                <strong>WHEREAS, </strong>said Court has given the County an opportunity to submit a remedial plan to correct this violation and to submit an election schedule;      </p>
<p>                <strong>NOW, THEREFORE, BE IT RESOLVED </strong>that the Remedial Plan offered by the County shall be:</p>
<p>                A two-district plan, which includes one single-seat super-majority district for the Native American minority and one multi-member district encompassing the remainder of the county.  The single-seat Native American super-majority district will be comprised of a nearly 78% Native American majority. This will provide Native American voters in Fremont County an equal opportunity to participate in political process and to elect preferred candidates of their choice.  Only voters from that district could vote for candidates running for the commissioner’s seat representing District 1. Candidates for the District 1 seat would be required to reside in District 1.  The remaining voters comprising District 2 would vote for the four (4) remaining commissioner seats at-large. Candidates for the District 2 seat would be required to reside in District 2.</p>
<p>                Under this preferred plan, the county’s population has been split into two districts, with District 1 accounting for approximately one fifth (20%) of the total county population, and District 2 accounting for four fifths (80%) of the total county population.</p>
<p>To maintain continuity on the Board, elections will remain staggered, with two commissioners being elected during presidential election years and three commissioners being elected on other even-numbered, non-presidential election years. The two commissioners who were elected in 2008 will remain in office until their terms expire in 2012. The 2010 election (and subsequent elections every four years) would be for:  a) the District 1, single-seat super-majority district commissioner seat, elected by residents of District 1, and b) the two at-large seats elected by residents of District 2. The 2012 election (and subsequent elections every 4 years) will be for two at-large seats from District 2, elected by residents of District 2.</p>
<p><strong>                IT IS FURTHER RESOLVED</strong> that, should the Court reject the County’s Remedial Plan, the County asks that the Court adopt this Alternative Plan:</p>
<p>                The Board’s alternative plan includes one single-member district and four residential district seats to be filled by an at-large voting system. The Native American super-majority district, District 1, will be comprised of a nearly 78% Native American majority.  The voters in the remaining four districts (Districts 2-5) would vote for candidates at-large. <p>Emergency Management Coordinator Kathi Metzler presented concerns for the Fremont County Commissioners/Emergency Council for future discussion.  She also presented a spreadsheet of County payments to date for flood mitigation costs.  She presented helpful hints for sandbag cleanup after the flood for review as well.</p>
<p>Youth Services Director Chuck Kratz reviewed the $1 million ARRA grant money available and stated he is researching technical assistance for a juvenile detention center.  He is currently looking at numbers of youth that would be served.  He has had discussion with the Juvenile Community Services Board.  He will report back at a later date and will not make any financial decisions until further discussion with the Commissioners.</p>
<p>The Board reviewed the renewal County Commissioner Scholarship applications and submitted their weighted votes.  Based on the tallies, Dennis Heckart moved, Dennis Christensen seconded, to award the County Commissioner Scholarship renewal application to Brady Samuelson and name the first alternate as Carla Moss.  Motion carried unanimously.</p>

<p> e Board recessed the meeting until 10:45 a.m. in order for them to attend a Command Center briefing regarding the flood situation in Fremont County.  The Commissioners will also tour several area bridges to look at damages.  The Board reconvened at 10:45 a.m. </p>
<p>Board interviews were held as follows: </p>
<p>Barbara Gose and Dorothy Remy (Fremont County Library Board), Donna Thompson (Fremont County Library Board and Fremont County Planning Commission). </p>
<p>Sherry Moore and RoJean Thayer (Fremont County Historic Preservation Commission). </p>
<p>Vice-Chairman Hickerson was excused to attend ongoing briefings related to the flooding.</p>
<p> Later in the meeting, Dennis Heckart moved, Dennis Christensen seconded, to re-appoint Barbara Gose and Dorothy Remy to three year terms on the Fremont County Library Board.  Voting against the motion: Doug Thompson.  Motion carried. </p>
<p>Dennis Heckart moved, Dennis Christensen seconded, to appoint Donna Thompson to a three year term on the Fremont County Planning Commission.  Motion carried unanimously.  The Board signed a letter of appreciation to Lucas Fidler for his past service on said Commission. </p>
<p>Dennis Christensen moved, Dennis Heckart seconded, to re-appoint Sherry Moore and RoJean Thayer to three year terms on the Fremont County Historic Preservation Commission.  Motion carried unanimously. </p>
<p>Vehicle Transportation Department Administrative Secretary Pennie Buffington reviewed a renewal contract with Communication Technologies, Inc. for Fremont County Radios, totaling a monthly rate of $2,398.23.    The amount is up from last year’s agreement of $2,344.28 to include several new radios purchased through Homeland Security for Public Health.  Dennis Heckart moved, Dennis Christensen seconded, to approve a contract for the upcoming FY 2010-11 in the amount of $2,298.23 with Communication Technologies, Inc.  Motion carried unanimously. </p>
<p>Pennie Buffington stated the Vehicle Maintenance Department is waiting the results of bids compiled through the Wyoming Department of Transportation’s bidding process for the upcoming fiscal year.  The County then has the option to be a sub bidder if they accept WYDOT’s supplier.  Vehicle Maintenance Supervisor Glen Steers will present the final WYDOT bid tabulations at the June 22<sup>nd</sup> meeting and make his recommendation to the Board at that time. </p>
<p>In other business, Pennie Buffington stated Transportation Superintendent Dave Pendleton will do pit reports after the flooding to determine the amount of sand used during the current flooding situation.  Treasurer Scott Harnsberger was present in the audience.  Many entities are using the sand at this time and he felt this would be the best way to get a reading on what was used from the various County pits by doing before and after pit reports.    She has also been working with Bookkeeping in order to code flood related expenditures as such so that accurate accounting will occur. </p>
<p>Vice-Chairman Pat Hickerson returned to the meeting. </p>
<p>A Public Hearing was held at 1:45 p.m. (originally scheduled for 10:30 a.m.) regarding Unanticipated Revenues and Budget Transfers within FY 2009-10.  Present were County Clerk Julie Freese and Financial Assistant Mike Stalder.  As a result of the flooding situation, Stalder recommended several Budget Transfers be made to several departments associated with emergency expenditures (fuel, over time, etc).  Dennis Heckart moved, Pat Hickerson seconded, to approve Resolution 2010-15.  Motion carried unanimously.  </p>

<p><strong>IMPLEMENTATION OF THE PROVISIONS OF SECTION</strong></p>
<p><strong>414(h)(2) OF THE INTERNAL REVENUE CODE, REGARDING FREMONT COUNTY/LAW PICK-UP OF EMPLOYEE RETIREMENT CONTRIBUTIONS TO THE WYOMING RETIREMENT SYSTEM</strong></p>
<p><strong> </strong><strong>WHEREAS</strong>, Fremont County/Law has the authority to implement the provisions of section 414(h)(2) of the Internal Revenue Code (IRC); and</p>
<p> <strong>WHEREAS</strong>, Fremont County/Law took official action regarding section 414(h)(2) IRC on June 1, 2010 and</p>
<p> <strong>WHEREAS</strong>, Fremont County/Law wishes to adopt this resolution in order to have additional documentation confirming its prior formal actions to pick up contributions under the Plans. </p>
<p> <strong>WHEREAS</strong>, Fremont County/Law has determined that even though the implementation of the provisions of section 414(h)(2) IRC is not required by law, the tax benefit offered by section 414(h)(2) IRC should be provided to its employees who are members of the Wyoming Retirement System:</p>
<p> <strong>BE IT HEREBY RESOLVED BY THE GOVERNING BOARD OF FREMONT COUNTY/LAW AS FOLLOWS:</strong></p>
<p> I.              That Fremont County/Law will implement the provisions of section 414(h)(2) Internal Revenue Code by making employee contributions pursuant to W.S. § 9-3-412(b) on behalf of its employees who are members of the Wyoming Retirement System. “Employee contributions” shall mean those contributions to the Wyoming Retirement System which are deducted from the salary of employees and are credited to individual employee’s accounts.</p>
<p> II.            That the contributions made by Fremont County/Law to the Wyoming Retirement System, although designated as employee contributions, are being paid to the Wyoming Retirement System by the Fremont County/Law in lieu of contributions by the employees who are members of the Wyoming Retirement System.</p>
<p> III.           That employees shall not have the option of choosing to receive the contributed amounts directly instead of having them paid by Fremont County/Law to the Wyoming Retirement System.</p>
<p> IV.           That Fremont County/Law shall pay to the Wyoming Retirement System the contributions designated as employee contributions from the same source of funds as used in paying salary.</p>
<p> V.            That the amount of the contributions designated as employee contributions and picked-up by Fremont County/Law to the Wyoming Retirement System on behalf of an employee shall be the entire contribution required of the employee by the Wyoming Retirement Act.</p>
<p> VI.           That the contributions designated as employee contributions made by Fremont County/Law to the Wyoming Retirement System shall be treated for all purposes, other than taxation, in the same way that member contributions are treated by the Wyoming Retirement System.</p>
<p> VII.          This resolution is effective on the same date that Fremont County/Law first provided for employee contributions, and shall apply prospectively to all future employee contributions.   </p>

<p>Commissioner Christensen reported on the monthly Fremont County Library Board meeting he attended last week.  He relayed Commissioner Heckart’s concerns regarding the earlier requested report on 1% expenditures.  The Board stated they are working on the report and expect it to be done by July 1<sup>st</sup> for the Commissioner’s review.  The Joint Travel Interim Committee will be meeting tomorrow in Evanston and the Wyoming County Commissioners Association will recommend that County Commissioners would like the process of setting speed limits on county roads (improved and unimproved) to be easier to accomplish at the local level by not having to retain professional engineers to conduct “an engineering and traffic investigation” as currently required by state statute.</p>
<p>Commissioner Hickerson reported on the flood damages and emergency procedures in place around the County.  Lander Crew Chief Jim Hedges is sending employees home today as the crisis is expected to be the highest between 10:00 p.m. – 4:00 a.m.</p>
<p>Chairman Thompson will be meeting tomorrow with a representative of Regional Economic Models, Inc (REMI) regarding their software that provides a model for economic forecasting and policy analysis.</p>
<p>County Clerk Julie Freese stated she had two small cameras installed for better coverage at the front counter.  The cost of the cameras were $695 each, including cost of installation.  She asked the Commissioners if they would be interested in having cameras installed in their chambers, particularly to cover the Commission minutes books.  Dennis Christensen moved, Dennis Heckart seconded, to approve installation of one camera in the Commission Chambers and one in the back office at a cost of $695 each.  Motion carried unanimously.</p>
<p>Julie Freese has met with the County Attorney’s Office to review the proposal to the courts regarding the Defendants’ Proposed Remedial Plan that will be filed this week and will present plans to the court in a preferred order:   </p>
<p>Julie Freese distributed copies of the updated budget, including all changes made the previous meeting.  The budget is currently based on $762,000,000 assessed valuation. </p>
<p>Pat Hickerson moved, Dennis Christensen seconded, to accept a voucher to Thoman H. Coyne in the amount of $195.00 for training for the Juvenile Treatment Court.  Motion carried unanimously.</p>
<p>Interviews were held with Eileen Urbigkeit, Butch Tonkin and Kathy Weger for two vacancies on the Fremont County Museum Board. </p>
<p>Wayne Steinert and Bobby Hague interviewed for re-appointment to the Fremont County Recreation Commission.</p>
<p>Dennis Heckart moved, Pat Hickerson seconded, to re-appoint Eileen Urbigkeit and Butch Tonkin to three year terms on the Fremont County Museum Board and re-appoint Wayne Steinert and Bobby Hague to three year terms on the Fremont County Recreation Commission.  Motion carried unanimously.</p>
<p>Chairman Thompson will review the application for the expansion of the South Pass District and relay his comments on to Sherry Moore, Historic Preservation Commission.</p>

<p>Qualifications:</p>
<p>Emergency Medical Technician-Intermediate with full module skills in Multi-lumen airway, IV/IO, manual defibrillation, needle chest decompression, cardiovascular &amp; medical emergency medications;</p>
<p>Possess desirable personality traits to include; leadership skills, problem solving, emotional stability, resourcefulness, cooperative, pleasant, neat and clean, and possess positive personal habits;</p>
<p>Possess valid driver’s license.</p>
<p>Prefer minimum of 3 years experience as EMT-I</p>
<p>Solid understanding of the National Incident Management System (NIMS) with minimum of 16 hour ICS/NIMS course or equivalent in field experience.</p>

<p>Physical Requirements:</p>
<p>Occasionally: Smelling; Frequently:  Lifting and/or assist lifting of 200 lbs., kneeling, stooping, bending, leaning, flexibility, multiple physical activities performed at the same time (carrying multiple equipment while pushing on cot).  Constantly:  Hearing/listening, clear speech, simple touching, walking (inside and outside), pushing, pulling, reaching, sitting, driving ambulance, seeing.</p>
<p>Working environment:</p>

<p>The museum seeks an energetic and motivated person to join a small staff and define museum exhibits and programs. This is an exciting time for the Dubois Museum.  The 4,000 square foot building includes exhibit space and a small gift shop. A small historic residence serves as staff office space. The Fremont County Museums Board is in the process of planning for a potential new facility.</p>
<p><br class="spacer_" /></p>
<p>The site is adjacent to the Town of Dubois-owned Dennison Lodge and the National Bighorn Sheep Center. It is also a short distance from the Headwaters Art &amp; Conference Center.</p>
<p><br class="spacer_" /></p>
<p><strong>Responsibilities:</strong> The primary responsibilities will be to function as administrator for the Dubois Museum.  That responsibility includes the study and understanding of local history and museum collections in order to design and prepare exhibits for installation in the facility.  The Director works closely with the curator, archivist and other part-time staff to research, design exhibits, and prepare exhibits for installation.  Additional responsibilities include assisting with public programming, working with area schools, marketing the museum, and working closely with a support organization.</p>

<p><strong>Qualifications:</strong></p>
<p>Minimum qualifications include Bachelor&#8217;s degree or equivalent (Master&#8217;s degree preferred) with major course work in museum administration or a related field and five years of professional experience in museum work or a related field or any equivalent combination of education and experience.</p>
<p>The Dubois Museum Director is an employee of Fremont County, Wyoming and receives benefit package with a starting annual salary of $<em>39,646</em>. The combined value of the salary and benefit package is up to $<em>61,610</em> depending upon eligibility and choice.</p>
