The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present:  Chairman Douglas L. Thompson, Vice-Chairman Pat Hickerson, Dennis Christensen, Keja Whiteman and Travis Becker. County Clerk and Clerk of the Board Julie A. Freese was present for the meeting. 

Pat Hickerson moved, Dennis Christensen seconded, to approve the Agenda.  Motion carried unanimously.   

Travis Becker moved, Dennis Christensen seconded, to approve the Minutes of the Regular Meeting held January 3, 2012.  Motion carried unanimously.

Keja Whiteman moved, Travis Becker seconded, to accept the regular bills for payment, with the exception of two vouchers, pending clarification.  Motion carried unanimously.   Later in the meeting after discussion with Sheriff Hornecker, Travis Becker moved, Dennis Christensen seconded, to accept a voucher from First Intestate Bank in the amount of $50 for credit chard charges to Smiths.  Motion carried unanimously.  Pat Hickerson moved, Travis Becker seconded, to accept a voucher from First Interstate Bank for charges related to the purchase of leather gloves.  Motion carried unanimously.   

Keja Whiteman moved, Travis Becker seconded, to accept a voucher from EBMS for employee health insurance claims in the amount of $101,707.53.  Motion carried unanimously.  The Board will request an update from the Executive Health Committee regarding how the plan is tracking.

A letter was approved to Lander Regional Hospital denying payment of two Title 25 claims as these 2011 charges were settled under the recent Settlement Agreement.

The following items in the Signature File were reviewed.  1) Certificate of Appreciation to Building Maintenance Supervisor J.R. Oakley and Carpenter Steve Averill for construction of the new desks and table for the Commissioners Chambers; 2) thank you letter to Don Beard for acting as a as Viewer in the Bunker Road Alteration Process; 3) Surety Bond for Commissioner Hickerson; and 4) Record of Proceedings.  Keja Whiteman moved, Travis Becker seconded, to approve a Wyoming Business Council Investment Ready Communities Business Ready Community Grant and Loan Program Annual Report for the Alco Building Development Project in Riverton.  Motion carried unanimously.

The Board reviewed an Affidavit for Agricultural Classification submitted by the County Assessor Tara Berg regarding the Major property in Riverton.  They will forward to the County Attorney’s Office for inclusion in the lease agreement that will be finalized the end of the month after selection of the lessee.

A public information meeting regarding the Mortimore Lane bridge reconstruction has been scheduled by WWC Engineering for February 9, 2012 at 6:30 p.m. at the Fremont County Library branch in Lander.  More information will be forthcoming.

Sheriff Skip Hornecker reviewed December Detention statistics by indicating there were a total of 138 inmates incarcerated in-house, 161 total and seven out of County.  This compares to figures of one year ago of 149 in-house, 182 total and zero housed out of county.  Fifty-five inmates (50 in house, five in treatment) of the total 161 inmates are sentenced.  Two hundred nine intakes were recorded in December, 106 inmates in Detention are pre-sentenced. 

Communications has two open positions with one applicant in the final hiring stages of the background process.   Detention currently has three open certified positions.  Plans are to reopen the Juvenile Detention Center by the end of January.  Patrol/Enforcement has a vacant Investigator position in the Riverton division. 

Lt. Carl Freeman joined Sheriff Hornecker to provide an update on the low level towers by stating they are both operating and have enhanced the trunking system tremendously.  The police departments are expected to convert in March which will enhance public safety within the County.  The County is responsible for all the utilities and upkeep on the towers.  Building Maintenance Supervisor J.R. Oakley had earlier discussed the billing responsibility of the towers by stating he had not budgeted for any additional expenses within his budget for the towers.  Freeman stated there is a monthly flat rate of $32/site plus usage and he further expected summer costs to be higher due to air conditioning.  Other associated costs would be a propane tank at each site that is necessary for emergency back up in the event of a power outage.  The rule of thumb is to keep the tank with enough propane for a 14 day emergency in the case of a natural disaster.  The Board agreed to have the utilities paid from the Building Maintenance line item to keep consistency within the County, with the acknowledgement the Building Maintenance line item for utilities may need to be increased before the end of the fiscal year.

Chairman Thompson stated the BLM Resource Management Plan is in the draft stage and asked if the Sheriff had any concerns with additional towers being needed in the Jeffrey City, Green Mountain or South Pass areas.  They stated they did not see the need for additional towers in these areas in respect to public safety. 

Popo Agie Conservation District Supervisor Jeri Trebelcock reviewed the joint efforts of the City of Lander, District and County in seeking assistance through the Army Corps of Engineers for funding for a flood control feasibility study.  The County had sent letters in 2010 and 2011 requesting assistance; however, in 2006 Congress imposed a moratorium on new studies.  As a result, the Corps suggested the partners consider a Section 22 Study under planning assistance of the state program that will provide an opportunity to continue moving forward.  Under this Section, there are two phases:  1) work with partners to review existing information for inconsistencies; and 2) resolve the inconsistencies.  To start the process, an agreement needs to be in place and Trebelcock distributed a Memorandum of Understanding for the Board’s consideration.  She stated the Corps will be in Lander on January 23-24, 2012 and would like to meet with the City and County, as partners in the process.  A tentative time during the Commissioners regular meeting on January 24^th was set for 12:30 – 2:30 p.m.  Keja Whiteman moved, Pat Hickerson seconded, to approve the Memorandum of Understanding between Popo Agie Conservation District and the Board of Fremont County Commissioners.  Motion carried unanimously.  A like MOU will be submitted to the City of Lander.

Solid Waste Disposal District CPA Susan Brodie was joined by District Supervisor Andy Frey and Chairman Mike Adams to review an upcoming budget hearing for unanticipated revenue.  Assessor Tara Berg and Deputy Lisa Campbell and Scott Harnsberger were present in the audience.  The budget for FY 2011-12 has been amended to address the error in calculating the mill levy which was calculated using the prior year assessed valuation.  The corrected calculation results in additional tax revenue of $554,706.  The Board intends to apply the additional revenue to the reserve account to be used for the future closure and post-closure costs.  The additional mill levy increase to the reserve brings that to a total of $1,204,706.  The estimated closure and post-closure costs, as of the most recent financial statements, is $6,000,000.  Keja Whiteman moved, Dennis Christensen seconded, to approve the Notice of Hearing for Unanticipated Revenues of $554,706 to be held on February 13, 2012 at 9:30 p.m. at the District Office.  Motion carried unanimously.  In closing, County Clerk Julie Freese stated the District had indicated in their budget message any additional income would be put in the closure costs line item.  The Board welcomed Susan Brodie as the District’s CPA and acknowledged Mike Adams as the new Chairman of the Solid Waste Disposal District Board.

Treasurer Scott Harnsberger reviewed the Fremont County Statement of Investment Policy that was adopted in 2008 pursuant to the requirements of W.S. § 9-4-831(h).  The document states “it is the policy of the Fremont County Treasurer to invest public funds in a manner which will provide a reasonable rate of investment return while securing principal and meeting the cash flow demand of Fremont County, and conforming to all federal, state and local laws and regulations governing the investment of public funds”.  Following review, the Board acknowledged the Policy that is in place.  In other business, Pat Hickerson moved, Travis Becker seconded, to approve Certified Resolution 2012-02.  Motion carried unanimously.

Chairman Thompson adjourned the Regular Meeting of the Board of Fremont County Commissioners and convened as the Fremont County Boundary Board.  Present were Assessor Tara Berg and Treasurer Scott Harnsberger.  W.S. § 21-6-205 was reviewed that states the district boundary board shall elect a chairman who will call a meeting of the district boundary board in the first quarter of each calendar year for the purpose of electing one of the members as secretary.  Thereafter, meetings shall be held upon the call of the chairman or a majority of the members of the board.  Composition of the district boundary board is the five County Commissioners and the Assessor and Treasurer.  Nominations were taken for the Chairman and Secretary with unanimous votes being cast for Doug Thompson to serve as Chairman and Assessor Berg to serve as secretary.  Pat Hickerson moved, Dennis Christensen seconded, to appoint Doug Thompson as Chairman and Assessor Tara Berg as Secretary.  Motion carried unanimously.  The Board returned to Regular Session.  Commissioner Whiteman stated School District 21 is planning to submit a petition to change the district from a K-8 to a K-12 district. 

County Planner Ray Price was present to inform the Board that developer Mr. McPherson would like to vacate all but lot 1 of the McPherson Simple Subdivision.  Lot 1 has been sold, and some of Lots 2, 3, 4 and 5 and will be returned to agricultural use and the remainder will become McPherson Subdivision #2.  Travis Becker moved, Pat Hickerson seconded, to approve the Plat Vacation of McPherson Subdivision, excepting Lot 1.  Motion carried unanimously.  Price stated McPherson Subdivision #2 is being proposed that will be a four lot simple subdivision on part of the previous Lots 2, 3, 4 and 5 of McPherson Subdivision.  Travis Becker moved, Dennis Christensen seconded, to approve McPherson Subdivision #2.  Motion carried unanimously.

Jerry Crews, Richard Inberg and Ivan Judd were present at the request of the Commissioners, as they had agreed to perform the duties of Appraisers in the Bunker Road Alteration process.  Dennis Christensen moved, Pat Hickerson seconded, to appoint Jerry Crews, Richard Inberg and Ivan Judd as Appraisers.  Motion carried unanimously.  The Oath of Appraiser was then given to each individual by County Clerk Julie Freese.  Travis Becker moved, Keja Whiteman seconded, to approve the Timeline for Bunker Road Alteration, as earlier presented by the County Attorney’s Deputy County Attorney, Jodi Darrough.  Motion carried unanimously.  The three Appraisers discussed a date and time to view Bunker Road on the ground and the date of January 19, 2012 at 1:00 a.m. was set.  The official Order appointing the appraisers and setting the date to view will be drafted and sent to all interested parties.

The Board briefly reviewed the 2012 County Commissioner Liaison List.  The Courts have asked for a Liaison and the 1838 Rendezvous Association and Yellowstone Development District will be contacted to see if they still require a liaison.  Final designations will be made at the following meeting.

Commissioner Whiteman stated the Fremont County Fair Board will be making a presentation to the Commission in the near future regarding the Riverton Depot Foundation’s proposal to swap land for a river walk. 

Commissioner Christensen reported on the monthly Fremont County Library Board meeting he attended.  Evaluations are taking place and a MOU has been signed with the Wyoming Life Resource Center for storage of books while the Carnegie Room is being remodeled.  He further relayed a comment from a concerned citizen regarding the placement of mailboxes on Burma Road.  He had also requested County Clerk Freese request the policy of other counties regarding logos on county owned vehicles, specifically related to the Coroner’s opposition to the placement on Coroner vehicles.

A work session was held with Eastern Shoshone and Northern Arapaho Division of Transportation representatives John Smith and Howard Brown.  Also present was WYDOT Chief Engineer Delbert McOmie.  Fremont County Transportation Superintendent Dave Pendleton was present via speaker phone.  Also present in the audience were Cody Beers, Keith Compton and Robert Scheidemantel.  The Cheyenne meeting of  January 5, 2012 Tiger 3 Grant meeting notes were reviewed that stated $8,277,000 is a direct grant to the Eastern Shoshone/Northern Arapaho Joint Business Council for fiscal management of funding for the reconstruction of the west end of 17 Mile Road.  There is also $5 million matching CRIP funding allocated to the project.  The Wind River Tribal Transportation Department will be responsible for quality control and WYDOT will provide quality assurance.  JBC would most likely do the grading and placing the gravel base with tribal forces and contract out the paving portion.  The Wind River Tribal Transportation Department will coordinate with the BIA Irrigation to install the first two miles of pressurized lines on one end of the project and the grading will begin on the other side, with work expected to commence in April.  Discussion regarding MOU’s in place was held for the two year project.  McOmie stated they are working on deadline dates at the current time for the project that will have a substantial amount of federal oversight.  Smith stated their department has successfully completed 31 projects over five years and are very well qualified.

In other business, John Smith reviewed the Long Range Pedestrian Walkway plan being conducted by James Gores and Associates.  The walkway is essential as the Wind River Indian Reservation leads the nation in pedestrian fatalities.  He expects the plan to be ready for review by the County in early February.  The West River Crossing study was discussed with a public information meeting scheduled the end of the month.  They were also awarded a Federal Highway Pilot Safety Project grant for an overall study of Reservation roads and specifics related to costs related to accidents.  A uniform municipal code project between WYDOT and the Technical Assistance Program will allow experts to determine what improvements are needed and available funding sources.  The Joint Business Council has expressed concern regarding the County’s fencing policy as there are numerous fences along county roads requiring repair.  Pendleton stated the County Policy states the County rebuild a fence if the road is rebuilt, otherwise, landowners are responsible for the fences.  The status of the replacement of Wilderness Bridge was discussed and Smith stated plans were submitted and a design flaw was noted regarding the footings.  A revised plan will be submitted for redesign.

In closing, Commissioner Hickerson stated his concerns that Region 5 funding is being transferred to areas surrounding interstates and he felt mountain roads are a huge issue. McOmie stated the funding is shifted from highway improvement projects to highway maintenance programs. 

Executive Health Committee members Margy Irvine and Jim Massman were joined by Cobecon Account Manager Rob Henderson and Consultant Account Manager Dianna Madvig who presented a timeline of their review of the County’s health benefit plan.  January projects include a comprehensive review of the current programs, initial strategy and review session, collection of information, review of contracts and submission of claim file to data mining vendor.  June is the expected date to set budget costs with an operational review in July. A County contact list was requested by Henderson so they can provide monthly reports.  The Wyoming County Commissioners Association is conduction a statewide survey of health related information and Cobecon will submit the requested information for statistical purposes only.

County Clerk Julie Freese was joined by Deputy Margy Irvine to review draft maps for the Commissioner Redistricting process as required following the 2010 census figures.  Sara McWain was present in the audience.  Freese recommended a work session in the near future as they need to reset precinct boundaries by the Commissioners’ first meeting in April (unless legislation changes the deadline to May 1^st).  She provided figures for current commissioner districts based on the 2000 census; the 2010 census, the Voter Rights Act Preferred Plan 2010 and CY2010 Preferred Plan (Legislative Plan).  The Board stated they would schedule a work session during their January 24^th meeting to adopt one or possibly two plans so that town meetings can be scheduled to disseminate the information and get public comments.

Ambulance Director Lauri Wempen briefly joined the meeting to request approval of her recommended candidate for the Lander Captain position.  Pat Hickerson moved, Keja Whiteman seconded, to approve the preferred applicant for the Lander Captain position at a salary of $28,000 plus benefits.  Motion carried unanimously.

County Clerk Julie Freese reviewed a suggestion on whether the County could have a separate place on the County website for employee access only.  This area could include inter-departmental memos, wellness information, etc.  She stated the webmaster stated this is possible for a cost of approximately $500. As the Commissioners budget for the website, their concurrence would be necessary.  Commissioner Whiteman stated she would like to discuss the request during an upcoming meeting to strategize the necessity of such an option and report back.

Vice-Chairman Hickerson reported on the Fremont County Solid Waste Disposal District monthly meeting held the previous day.  He informed the Board that Dr. Dale Groutage had submitted his resignation from the District Board, effective immediately, and the Commissioners acknowledged the resignation with regret. Commissioner Hickerson will attend a meeting the following day in Cody with the Regional Forest Staff out of Denver regarding the Forest Plan Revision process.  Attended a Fire Plan Meeting with the Northwest Management Team to discuss amendments to the fire plan.

Chairman Thompson has participated in numerous conference calls regarding the Bureau of Land Management Resource Management Plan draft.  He distributed copies to the Board and asked for their review and comments.  Pat Hickerson moved, Travis Becker seconded, to approve the draft RMP pending comments submitted by the end of the week.  Motion carried unanimously.

There being no further business, Travis Becker moved, Dennis Christensen seconded, to adjourn the meeting at 5:00 p.m. and reconvene at 9:00 a.m. on January 24, 2012 for a Regular Meeting.  Motion carried unanimously.

The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present:  Chairman Douglas L. Thompson, Vice-Chairman Pat Hickerson, Dennis Christensen, Keja Whiteman and Travis Becker. County Clerk and Clerk of the Board Julie A. Freese was present for the meeting. 

Pat Hickerson moved, Travis Becker seconded, to approve the Agenda.  Motion carried unanimously.   

Dennis Christensen moved, Pat Hickerson seconded, to approve the Minutes of the Regular Meeting held December 20, 2011 and the Special Meeting held December 22, 2011.  Motion carried unanimously.

Travis Becker moved, Dennis Christensen seconded, to accept the regular bills for payment.  Motion carried unanimously.  County Clerk Freese will clarify a mileage reimbursement check and report back for the Board’s information.

The Board reviewed two Title 25 bills from Lander Regional Hospital and will subsequently send a letter to LRH stating a Settlement Agreement has been reached and these charges are under said Agreement and will not be paid individually.

The following items in the Signature File were reviewed:  1) Invitation to legislators to attend a dinner hosted by the Commission on February 15^th in Cheyenne; 2) BLM MOU regarding Rock Springs Resource Management Plan Revision that will be amended by Chairman Thompson; and 3) Record of Proceedings.  Pat Hickerson moved, Keja Whiteman seconded, to approve Amendment Number One to the Cooperative Agreement between the Wyoming Department of Transportation and the Fremont County Commission regarding Mortimore Lane Bridge Replacement, pending review by the County Attorney’s Office.  Motion carried unanimously.  Pat Hickerson moved, Dennis Christensen seconded, to approve an Office a Grant Award for U.S. Department of Homeland Security Federal Emergency Management Agency in the amount of $99,467.14.  Motion carried unanimously.  Pat Hickerson moved, Travis Becker seconded, to approve a Grant Award for U.S. Department of Homeland Security Federal Emergency Agency for Jeffrey City Fire District in the amount of $5,363.20; City of Lander for $31,586.89 and City of Riverton for $22,45236.  Motion carried unanimously.  Travis Becker moved, Keja Whiteman seconded, to approve a Highway Easement Deed between Federal Highway Administration and Fremont County for Wyoming Forest Highway Route 23 – Louis Lake Road.  Voting against the motion: Pat Hickerson.  Motion carried.

Several items in the Priority Mail were discussed.  There will be an Open House to meet Steve Schacht, new District Ranger of the Washakie Ranger District, Shoshone National Forest, on January 12, 2012 at the District Office.  The finalized Settlement Agreement with Lander Regional Hospital for Title 25 patients totaling $457,378.10 through December 15, 2012 was acknowledged.  Chairman Thompson expressed appreciation to Commissioners Whiteman and Hickerson for bringing LRH’s complaint in District Court to a successful conclusion regarding this issue.  Chairman Thompson will visit with Senator Cale Case regarding his letter to the Board regarding Bunker Road and specifically his request to see a list and description of all private roads in Fremont County that either cross or touch public lands as County Clerk Freese stated the only thing of record is County maintained and County owned roads.  The Board reviewed a letter from the City of Lander informing them that the Shearer #2 Candidate Site is one of four sites being considered for the Lander Rodeo Grounds relocation.  The County Shop is an adjoining landowner.  Vice-Chairman Hickerson stated he would attend the Public Hearing scheduled for later in the evening and review the Commissioners comments that the Commission is supportive of a highway site and the rodeo grounds are good for the economy and reinforce the “Cowboy State” image.  As this was the first notice the County had received regarding the process, they stated that a better notification process should be looked into so all pertinent landowners are contacted.  The Board will attend a work session with the Solid Waste Disposal District Board on January 24^th at 5:30 p.m.

Chairman Thompson opened up the floor for nominations for Chairman and Vice-Chairman.  Travis Becker moved, Dennis Christensen seconded, to nominate and re-appoint Doug Thompson as Chairman Pat Hickerson as Vice-Chairman for 2012.  Motion carried unanimously.

Dennis Christensen moved, Travis Becker seconded, to designate the following depositories for Fremont County Government for 2012:  Dubois: Wells Fargo Bank of Wyoming and Bank of Jackson Hole; Lander: Central Bank and Trust, Bank of the West, US Bank, Wyoming National Bank and First Interstate Bank; Riverton: First Interstate Bank, Bank of the West, Wells Fargo Bank of Wyoming, US Bank, Wyoming National Bank and Central Bank and Trust; and Fort Washakie: Central Bank and Trust.  Motion carried unanimously.

Dennis Christensen moved, Travis Becker seconded, to designate the Riverton Ranger and Lander Journal as the official county newspapers for Fremont County Government for 2012 with the remaining newspapers within the county to be used for other purposes.  Motion carried unanimously.

The Board took the County Commissioner Liaison designations under advisement and will make a final determination next week.  They noted several additional departments and committees that would need liaison designation.

The Board reviewed Wyoming State Statute § 21-6-205 that states the district boundary board shall elect a chairman and then call a meeting of the board in the first quarter of each calendar year for the purpose of electing one of the members as secretary.  The Board stated they would put this on another agenda in January as both the County Assessor and County Treasurer are members of the boundary board and would need to be in attendance.

Transportation Department Staff Engineer Bill Masson updated the Board on the Mortimore Lane Bridge project.  The Appraisers completed their study on December 30^th and the Negotiator plans on being here on January 4, 2012.

Public Health Nurse Manager Julie Twist joined the meeting for the fourth time regarding submission of an application for Title X Funding for a Fremont County Family Planning grant.  Due to procedural issues at the last meeting in December where Commissioner Hickerson was absent, the motion to submit the application could not be brought to the table for reconsideration.  As there was a full quorum present at the current meeting, Pat Hickerson moved, Keja Whiteman seconded, to make a motion to reconsider the motion of December 13, 2011 to submit the grant application.  Travis Becker voted against the motion to consider.  Motion carried.  Nurse Midwife Heidi Stearns also joined Twist and there were seven individuals present in the audience. Several members of the Commission still expressed concern and wanted to make sure a major portion of the grant went towards education.  Following discussion, a vote was called on the motion to submit the application for funding.  Voting against the motion: Pat Hickerson and Travis Becker.  Motion carried.

A Public Hearing was held at 10:15 a.m., as advertised, regarding Budget Transfers.  Present were County Clerk Julie Freese and Financial Assistant Mike Stalder who reviewed their reasoning behind increasing the budget transfer amount for Statutory Medical (Title 25) expenses from that earlier presented to the Board so that another budget hearing would not be necessary prior to the end of the fiscal year   Keja Whiteman moved, Travis Becker seconded, to approve Resolution 2012-01.  Motion carried unanimously.

Weed and Pest District Supervisor Lars Baker was present to review two Nomination Petitions submitted by Richard Klein and Joseph Crofts, both for at large districts.  Said Petitions contained signatures of ten landowners of Fremont County.  Dennis Christensen moved, Travis Becker seconded, to re-appoint the two incumbents, Richard Klein and Joseph Crofts, to four year terms on the Weed and Pest Control District Board.  Motion carried unanimously.

County Attorney Brian Varn was present for discussion regarding several items relating to the Bunker Road Alteration process.  At an earlier meeting, his Office had recommended the Commission hire a hearing officer for the public hearing scheduled for February 21^st, as well as dealing with any motions in the meantime.  Travis Becker moved, Pat Hickerson seconded, to appoint Travis Moffat as Hearing Examiner.  Motion carried unanimously.  In other business, discussion was held regarding possible names for three Appraisers.  It was noted that in previous private road applications, the Board had appointed a surveyor, engineer and realtor.  The Statutes indicate the three appraisers must be electors of the County with no specific qualifications mentioned.  Names of appraisers will be sought for the January 10^th meeting in order for them to take their oath.  Later in the meeting, it was brought to the Board’s attention that information sent to Bunker Road landowners on December 22, 2012 had been sent with inadequate postage for both return receipt and certified mail.  As a result, some of the landowners were rejecting the envelope.  Travis Becker moved, Pat Hickerson seconded, to send a letter allowing a one week extension for claims for damages from noon on January 3, 2012 to noon on January 10, 2012.  Motion carried unanimously.

Pat Hickerson moved, Travis Becker seconded, to adjourn into Executive Session with County Attorney Brian Varn regarding litigation.  Motion carried unanimously.  Travis Becker moved, Pat Hickerson seconded, to return to Regular Session.  Motion carried unanimously. 

County Coroner Ed McAuslan was joined by Pat Lawson, Fremont County Veteran’s Commission, and Don Stratmoen, Viet Nam Veteran and Riverton VFW Quartermaster, to continue discussion regarding the Fremont County Indigent Burial and Cremation Policy, specifically relating to Veterans.  Present in the audience were County Attorney Brian Varn and State Senator Cale Case.  The Policy currently states the amount of preparation shall not exceed $1,800 and the amount expended for transportation of the veteran’s body shall not exceed $500.  McAuslan distributed burial quotes from Hudson’s Funeral Home totaling $6,060 and Davis Funeral Home of $4,624.40.  The Commissioners requested similar quotes, but with expenses relating to cremation.  Discussion was held regarding how a veteran is determined to be indigent.  As there was some confusion regarding the Coroner’s duties to pursue this information, Varn stated the Coroner can inventory property, however, should not seize it.  There is a process for probate court to handle these matters.  He further stated the Coroner should have the authority to temporarily lock down property in order to protect it; however, a procedure should be developed to protect him.  McAuslan stated the current procedure is to provide the inventory to Winter Law Firm and if the indigent person has sufficient funds following the probate procedure, the firm gets their payment.  If not, they do not receive any payment.  The Board stated their appreciation to veterans and their service to the country, but stated they must comply with policy and statutes.  McAuslan referred to Wyoming State Statute § 19-14-101 that states the Commissioners shall provide for the preparation of the body and transmittal, however does not give a figure for preparation.  Senator Case will take comments to the Legislature for possible rewording to make the statutes clearer for counties as to their monetary responsibilities.  The Board requested McAuslan work with Senator Case, County Attorney Varn and Commissioner Becker to make amendments to the current County policy.

County Coroner Ed McAuslan proceeded to review the 2011 Year End Report.  Before proceeding, he stated there have already been two traffic fatalities in 2012.  The 2011 statistics were given as follows:  There have been 342 recorded deaths, 179 of which were Coroner cases (compared to 183 in 2010).  Among Coroner cases, 32.9% were “non natural” in manner:  accidental deaths was 22 (compared to 32 in 2010); suicide was 14 (8 more than 2010) and almost three times the national average for our population; deaths by homicide was 23 (compared to 9 in 2010) and 10.4 times the national average for our population; and motor vehicle/traffic deaths totaling 24 (seven accidental, sixteen vehicular homicides and one suicide).  50% of the total involved alcohol and/or drugs.  The rate in Fremont County for traffic fatalities is almost 5 times the national average for our population. Only five of the 24 fatalities were using seatbelts, with eight of the deaths from single vehicle rollovers.  The one suicide was responsible for four of the vehicular homicides.  After 7.5 years in a row without any completed youth suicides (17 and under) there have been three since the end of September, with ages of 17, 15 and 14.  The homicide number of 23 is the highest on record since 1885, with the previous high being 14 in 2008.  The nine child fatalities included three homicides, three accidents and the three suicides.  Drugs and alcohol related deaths account for 46 of the 179 Coroner cases or 25.6%, an increase over 2010 of 20.2%.  Of the non-natural deaths, 29 of 59 were drug/alcohol related, the same for 2010.  Of those drugs and alcohol related deaths, the primary substance of abuse in Fremont County remains to be alcohol, followed by prescription drugs.  Eleven of the 16 total motor vehicle homicides involved drugs and/or alcohol.  At mid-fiscal year, current budget usage is 52.7%, minus the $22,869 billed and expended for two unanticipated high altitude search and recovery efforts, budget usage would stand at 46.4%.  County Clerk Freese requested McAuslan get her actual amounts of the high altitude recovery costs and she would see if any funding still existed in Title III monies.

In final business, Ed McAuslan continued discussions regarding the Commissioner’s prior motion to remove light bars and sirens purchased for the Coroner suburbans with older ones and to save the newer ones for future use for Sheriff’s Department vehicles.  Vehicle Maintenance Supervisor Glen Steers was present for the discussion and County Clerk Julie Freese reviewed the Capital Revolving Fund procedures. McAuslan stated his concern that Departments request equipment and get Capital Revolving Fund approval from that committee and then final approval by the Commissioners, yet be denied at a later time by the Board.  He further stated light bars and sirens from old Sheriff’s vehicles are basically the same as what he ordered and had already been installed.  He further felt the Board had not had the necessary communication with him regarding their concerns prior to the motion to remove.  He further stated he would pursue training on the use of lights and sirens.  Commissioner Hickerson questioned why the Coroner’s vehicles need to run their lights and sirens, to which McAuslan stated they do not as a rule, but there have been instances when Wyoming Highway Patrol wants the Coroner there immediately which would require lights and sirens.  In closing, he reiterated he wants to keep the light bars and sirens already installed on the suburbans.  He had also earlier stated he did not want a County logo on the suburbans, to which the Board disagreed and stated they were County vehicles and required the logo.  In closing, McAuslan stated the felt the Board questioned his professional status regarding his wants and needs regarding the vehicles used in his Department.  Later in the day, Keja Whiteman moved, Travis Becker seconded, to allow the Coroner vehicles to keep the light bar and siren already placed on the units and to have the graphics added.  Voting against the motion: Doug Thompson.  Motion carried.

Commissioner Becker made several changes to the draft RFP for agricultural tenants for the Major Property.  Travis Becker moved, Dennis Christensen seconded, to approve the revisions and begin advertising the RFP with a proposal deadline of January 23^rd in time for review at the Commissioners January 24^th meeting.  Motion carried unanimously.

Chairman Thompson stated he would be attending a meeting on January 6^th at 8:00 a.m. in the Courthouse with Aaron Clark from the Governor’s Office regarding transmission lines.  He will then be presenting federal government issues at the January 5^th Leadership Wyoming meeting at the Best Western Inn in Lander.

Pat Hickerson moved, Keja Whiteman seconded, to accept a voucher from EBMS in the amount of $83,005.98 for health insurance claims.  Motion carried unanimously.

Vehicle Maintenance Supervisor Glen Steers joined the meeting to report on an accident in Atlantic City when the operator attempted to pull a vehicle off the road, which was stuck.  It was extremely slick and the motor grader slid into the vehicle.  The truck was then moved from the roadway and the operator continued to blade the road.  The Local Government Liability Pool was contacted regarding the incident.  The Board stated there should be a tow policy in place and the development of a liability waiver that states motorist assistance should only occur in the event of serious road hazard that presents a safety concern for other motorists would greatly reduce the instances of Fremont County exposing the employee and the County to unnecessary liability.

There being no further business, Travis Becker moved, Dennis Christensen seconded, to adjourn the meeting at 3:00 p.m. and reconvene at 9:00 a.m. on January 10, 2012 for a Regular Meeting.  Motion carried unanimously.

Thompson, Dennis Christensen and Travis Becker.  Vice-Chairman Pat Hickerson was absent for personal reasons and Commissioner Whiteman joined the meeting at 10:15 a.m. due to other obligations. County Clerk and Clerk of the Board Julie A. Freese was present for the meeting. 

Dennis Christensen moved, Travis Becker seconded, to approve the Agenda as amended.  Motion carried unanimously.   

Travis Becker moved, Dennis Christensen seconded, to approve the Minutes of the Regular Meeting held December 13, 2011.  Motion carried unanimously.

Dennis Christensen moved, Travis Becker seconded, to accept the regular bills for payment, with the exception of a one month rental agreement for a client of the CAST program, pending further information. Motion carried unanimously.  Later in the day after clarification of the location of the rental, Travis Becker moved, Dennis Christensen seconded, to pay the one month rent for a client of the CAST program until she can seek employment and sustain the rent on her own..  Motion carried unanimously.  The Board acknowledged an amended voucher to Hudson’s Funeral Home that was changed from the earlier approved amount of $2,300 to $2,095, based on actual mileage costs.  They further stated they would like clarification on a voucher to The Stock Doc from the department that accrued the late charge. 

Dennis Christensen moved, Travis Becker seconded, to accept a voucher from EBMS for health insurance claims in the amount of $152,398.37.  Motion carried unanimously.

Dennis Christensen moved, Travis Becker seconded, to accept a voucher from Fremont Counseling Service in the amount of $2,880 and from Lander Valley Medical Center in the amount of $1,950 for Title 25 patients.  Motion carried unanimously.  Travis Becker moved, Dennis Christensen seconded, to approve a letter to LVMC regarding a reduction in reimbursement for one patient based on a reduction in approved days.  Motion carried unanimously.

Emergency Management Coordinator Kathi Metzler was in the audience to answer questions regarding a Wyoming Office of Homeland Security form listing Fremont County’s proposed program budget for Fiscal Year 2012.  She stated the information is basically a change from the County’s format to the State’s, but includes the same funding.  Travis Becker moved, Dennis Christensen seconded, to approve the Wyoming County Proposed Program Budget as presented.  Motion carried unanimously.

The following items in the Signature File were reviewed: 1) Record of Proceedings; 2) letters to various outgoing County Board members; and 3) letter to University of Wyoming Cooperative Extension Service reiterating the County’s preference for the hiring of a Nutrition and Food Safety Specialist instead of a Community Development Education Specialist.  Travis Becker moved, Dennis Christensen seconded, to accept a Legal Services Contract between Fremont County and Terrance R. Martin to provide legal services to the County for review of evidence, filing and litigation of Title 25 involuntary hospitalization cases, pending correction of dates.  Motion carried unanimously.

Travis Becker moved, Dennis Christensen seconded, to approve Resolution No. 2011-33.  Motion carried unanimously.

RESOLUTION NO. 2011 –33

APPOINTMENT OF SPECIAL PROSECUTOR

                WHEREAS, the County and Prosecuting Attorney for Fremont County has entered into an agreement with Brett L. Johnson, County and Prosecuting Attorney in and for Sweetwater County, Wyoming, to prosecute a case (State vs Angela Ladd – CR-2011-0763), in which the Fremont County and Prosecuting Attorney’s Office has either a conflict of interest or which would have the appearance of impropriety if pursued by that office; and

                WHEREAS, Gregory J. Blenkinsop, designee of Brett L. Johnson, will provide his services free of charge to Fremont County, except that the Fremont County and Prosecuting Attorney’s Office shall reimburse for all costs and expenses from funds appropriated in that office’s budget; and

                WHEREAS, Wyoming Statutes 18-3-302 and 18-3-107 authorize such appointment with the consent of the Board of County Commissioners and said action provides a substantial benefit to Fremont County.

                NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Fremont County, Wyoming hereby consents to the appointment of Gregory J. Blenkinsop, designee of Brett L. Johnson, to serve as a special deputy county and prosecuting attorney in a particular case.

Travis Becker moved, Dennis Christensen seconded, to approve the 2010 distribution of $18,682 in Petersdorf Hospital Trust Income as follows:  $9,341.00 (50%) to the REACH Foundation for further distribution to the Riverton Senior Citizens, Inc., Sepiternal Society, Inc., Fremont County Hospice and other such institutions or organizations providing medical services or benefits and comforts for older people not otherwise available in the Riverton area as determined by the REACH Foundation; $6,725.52 (36%) to the Lander Senior Citizens; $1,120.92 (6%) to the Dubois Senior Citizens Center and $1,494.56 (8%) to the Shoshoni Senior Center.  Motion carried unanimously.

Chairman Thompson reviewed an Office of State Lands and Investments Board letter regarding an Easement Application submitted by Fremont County for a 20 foot easement for the Heritage Trail across State land.  Said letter stated the cost is estimated to be $1,040.38 and per State Statute, the County must remit a deposit of 75% of the estimated consideration for the proposed easement.  Travis Becker moved, Dennis Christensen seconded, to approve the amount of $780.29, being 75% of the estimated consideration for that portion of the Heritage Trail crossing State land.  Motion carried unanimously.

The Commissioners reviewed a letter from Assessor Berg, and specifically related to the Commissioners, a recorded Right-of-Way Deed on a Truck Trail that lies along an easterly part of said landowner’s property.  She will keep the Board informed of the landowner’s subdivision status and questions relating to agricultural classification.

Public Health Nursing Supervisor Julie Twist revisited the Board and provided additional information regarding her request to submit a grant application to the State of Wyoming for the Family Planning program to be administered by Public Health.  She presented additional information to answer abortion related concerns that several members of the Board had earlier expressed.  She reviewed a draft grant application and specifically referred to the appointment of a board, quality assurance and financial issues, all of which were expressed as concerns during the previous discussion.  A motion had been made at the December 13^th meeting to submit the grant application; however, failed on a three to two vote.  Chairman Thompson stated that procedurally, a member of the prevailing side must bring the motion back to the table, those members being himself, which he did not feel was appropriate, Vice-Chairman Hickerson, who was absent, or Commissioner Becker.  Commissioner Becker stated he still could not support the grant application, based on abortion related concerns.  High school student parent Pennie Buffington was in the audience and expressed her support of the program.  Since no action could be taken at this time, the Board continued to take the matter under advisement.

Transportation Superintendent Dave Pendleton stated he would be assembling follow up letters to three Atlantic City landowners following the December 8, 2011 meeting he had with them.  Staff Engineer Bill Masson is working on the Diversion Dam Bridge replacement project.  Pendleton stated the appraiser hired for the Mortimore Lane Bridge replacement project is not able to complete the needed work in the required time frame so the Wyoming Department of Transportation will take over and get an appraisal completed so they can begin landowner negotiations.

In other business, Dave Pendleton stated he met with the viewer that was selected by the Commissioners as part of the alteration process for Bunker Road.  The Viewer, Don Beard, had subsequently submitted his report via e-mail this date with a signed copy expected later in the day.  Dennis Christensen moved, Travis Becker seconded, to conditionally accept the electronically submitted Viewer’s Report, with the final signed copy expected later in the day as the prevailing report.  Motion carried unanimously.  The Board also reviewed a Public Notice compiled by the County Attorney’s Office for submission to the newspaper, for clarification that will state the current route of Bunker Road is the road on the ground from where point number 3 on the survey converges with, and is overlaid by, King Drive.  It further states Bunker Road, overlaid by King Drive, extends to point 8 on the survey and then proceeds, as travelled on the ground, through point 19 on the survey.  The appropriate legal description is also included.  Dennis Christensen moved, Travis Becker seconded, to approve the Public Notice for publication in the newspaper and distribution to affected landowners.  Motion carried unanimously.

Dennis Christensen moved, Travis Becker seconded, to adjourn into Executive Session with Fremont County Ambulance Director Lauri Wempen regarding personnel and potential property acquisition.  Motion carried unanimously.  Dennis Christensen moved, Travis Becker seconded, to return to Regular Session.  Motion carried unanimously.

Commissioner Whiteman joined the meeting at this time.

County Planner Ray Price presented a plat for the Vacation of Lots 4 & 5, Iiams Subdivision.  The landowners are petitioning for the vacation of the two lots from this subdivision because they have not been sold and are part of a larger haying operation.  The petition was approved by the Fremont County Planning Commission during their December 15, 2011 meeting on a unanimous vote.  Travis Becker moved, Keja Whiteman seconded, to approve the Vacation of Lots 4 & 5, Iiams Subdivision.  Motion carried unanimously.

Ray Price submitted Sandstone Mesa Subdivision, a Re-Plat of Viola’s Ridge Subdivision.  He stated this is a change of name for the simple three lot subdivision and was recommended for approval by the Planning Commission on a unanimous vote.  Travis Becker moved, Dennis Christensen seconded, to approve the Sandstone Mesa Subdivision.  Motion carried unanimously.

In final business, Ray Price stated John and Dana Smith are the sole owners of the Frontier Park Subdivision, consisting of a total of 35 acres and they wish to vacate the subdivision and return it to agricultural use.  The proposal was recommended for approval by the Planning Commission on a unanimous vote.  Travis Becker moved, Keja Whiteman seconded, to approve the vacation of Frontier Park Subdivision.  Motion carried unanimously.

County Coroner Ed McAuslan continued discussions regarding the Veterans Indigent Burial Policy.  The Board had earlier denied full payment to Hudson’s Funeral Home for a veteran indigent burial in the amount of $6,099.  The County’s policy states “the amount expended for preparation of the body shall not exceed $1,800.  The amount expended for the transportation of the veteran’s body shall not exceed $500”.  McAuslan again distributed copies of State Statute § 19-14-101(a) Burial of Indigents, stating in part “The board of county commissioners of each county shall provide for the preparation of the body and transmittal to and burial in the veteran’s cemetery or any other than a dishonorably discharged veteran ……….and who dies leaving insufficient funds to defray the necessary funeral expenses”.  The Board had then made the following motion on December 13, 2011 to authorize payment of $2,300 to Hudson’s Funeral Home for an indigent veteran burial, as per policy, with the balance being funded by the Coroner’s Department budget.  Discussion was held regarding the need for more clarification in State Statutes regarding actual amounts.  McAuslan informed the Board that the indigent veteran may have property, however, based on a County Attorney’s verbal opinion, stated his office had no right to secure that property.  The Board stated they would revisit the policy in January so the County Attorney can clarify that opinion.

In another continuing issue, Coroner McAuslan reiterated his request to have the light bar and siren purchased for the two Coronor’s Office suburbans remain on the vehicles, as they were both approved for purchase with the added equipment with funding through the Capital Revolving Fund.  The Board had earlier made a motion to have the light bars and sirens removed and replaced with recycled light bars and siren units from Sheriff’s Office vehicles that are being removed from the fleet. In closing, McAuslan stated it would be counter productive to take the time and labor to remove the light bars and sirens.  No further action was taken to McAuslan’s request at this time.

Keja Whiteman moved, Dennis Christensen seconded, to adjourn into Executive Session regarding personnel with Fremont County Museum Board members Tom Duncan, Butch Tonkin, Steve Banks and Jon Lane.  Motion carried unanimously.  County Attorney Brian Varn joined in mid session.  Dennis Christensen moved, Keja Whiteman seconded, to return to Regular Session.  Motion carried unanimously.

Wyoming State Legislators joined the Commissioners for a work session to discuss various issues of  importance to Fremont County.  Present were Senators Cale Case and Eli Bebout and Representatives Del McOmie, Rita Campbell and David Miller.  Items discussed were Optional 1% Projects submitted by the Fremont County Transportation Department totaling $72,971,000; Road Construction Fund 5-Year Prioritized Plan; one time state funding; BLM Resource Management Plan, Legislative Redistricting; Solid Waste issues; BIA joint jurisdiction possibility regarding motor vehicle code; Indigent Burial statutes.  In closing, the Commissioners thanked the Legislators for the opportunity for open discussion and feedback.  The Commissioners further stated their appreciation of the increased access to the Governor’s Office and staff, as Chairman Thompson stated the Governor has assigned a staff member to attend the upcoming cooperators meetings taking place in Rock Springs regarding the Resource Management Plan revision process.

Commissioner meeting reports were given:

Commissioners Whiteman and Becker attended a meeting with representatives from the City of Riverton, REACH Foundation, CWC and Fremont County Fair Board to begin discussions regarding the County’s plans for the newly acquired Major property in Riverton.  Commissioner Whiteman will meet with the Lander Valley Medical Center CEO Rebecca Brewer regarding negotiations for Title 25 payment claims.  The next Juvenile Detention Alternative Initiative Site Meeting visit will be held after the first of the year and the Commissioners will be invited once a date is set.  She visited the site in Billings, which is a smaller site than the one toured in Albuquerque in mid-December. 

Commissioner Becker also reported on the meeting with Riverton representatives regarding the Major property.  They discussed applying for a CDBG Planning Grant that could be in the best interests of all concerned.  He is also working with the County Attorney’s Office regarding an RFP for the Major property, and expects to have a final document by the January 3^rd meeting.He attended the Fremont County Planning Commission meeting on December 6^th, at which time they reviewed numerous subdivision plats and replats.  He attended an Audit Committee meeting with the auditors two weeks ago and reported they brought up the suggestion that the County hire a human resources person.  The feel the County does not have a grievance policy for the employees to be able to have a place to go other than their supervisor.  A suggestion is to have the Local Government Liability Pool attorney again provide monthly educational seminars relative to human resources and employment practices and discussion was held regarding this option and whether they should be mandatory. 

Commissioner Christensen attended the monthly meeting of the Fremont County Library Board and they selected new officers for 2012.  He expressed appreciation on the new management for the Library system.  He had a discussion with Pavillion Mayor Hamlin regarding the EPA water report.  The Commission discussed their belief that an expedited, independent study should be sought, but not infringe on an expedited solution to the citizens’ water situation and recommend serious consideration be given to safe drinking water in the meantime. They further stated the Governor’s Office or legislators should become involved to help supply safe water and possibly get financial assistance from the oil and gas companies in the area.

Chairman Thompson, as part of the Federal Lands Committee, addressed the Stock Growers Association meeting in Casper last week and then attended three different meetings the following day in Cheyenne (Wyoming County Commissioners Association Working Group dealing with federal planning processes; Economic Analysis Division Meeting; and finally met with the Wyoming State Historic Preservation Office regarding national historic trails).

County Clerk Julie Freese had earlier submitted her report for review and stated the Cobecon representatives wish to schedule a meeting with the Commission and Executive Health Committee members to begin reviewing the County’s Health Insurance Plan.  The date of January 10^th was set for the meeting.

Building Maintenance Supervisor J.R. Oakley was in the audience and reported that the Riverton Courts remodeling project is substantially completed.  He further requested clarification on the proper budget to fund the electricity billing for the new WyoLink low level towers.  The Board directed him to meet with the Sheriff and Emergency Management Coordinator to determine which of those two budgets should fund the monthly expense for the towers, as they should not be taken from the Building Maintenance Budget at this time.

There being no further business, Travis Becker moved, Dennis Christensen seconded, to adjourn the meeting at 4:15 p.m. and reconvene at 9:00 a.m. on January 3, 2012.  Motion carried unanimously.

The Board of Fremont County Commissioners met in Special Session at 1:30 p.m. with the following members present:  Chairman Douglas L. Thompson, Vice-Chairman Pat Hickerson, Keja Whiteman and Dennis Christensen. Travis Becker participated via speaker phone. County Clerk and Clerk of the Board Julie A. Freese was present for the meeting. 

Chairman Thompson stated the Special Meeting had been called due to various time constraints on several important issues, necessitating action prior to the end of the calendar year.

Chairman Thompson reviewed a corrected Legal Services Contract between Fremont County, Wyoming and Terrance R. Martin.  Said dates of service were corrected to coincide with the County’s fiscal year.  Said Agreement was signed by the Chairman and will become effective January 1, 2012.

Vice-Chairman Hickerson reviewed his discussion with Public Health Nurse Manager Julie Twist regarding her request to submit a grant application to the State of Wyoming for the Family Planning program to come under her administration.  She had presented information at the last three Commission meetings; however, a supporting motion had not been made.  She is to provide additional information to Commissioner Hickerson and he further stated Twist had received an extension on the grant deadline until January 3, 2012.  She will submit the grant without the signature page and the Board will have an opportunity to discuss the grant application at their next meeting of January 3, 2012.

Keja Whiteman moved, Pat Hickerson seconded, to adjourn into Executive Session regarding litigation with County Attorney Brian Varn and Deputy Jodi Darrough.  Motion carried unanimously.  Keja Whiteman moved, Dennis Christensen seconded, to return to Regular Session.  Motion carried unanimously.

Keja Whiteman moved, Dennis Christensen seconded, to conditionally accept the negotiated amount of $457,378.10 with Lander Regional Hospital d.b.a. Pine Ridge with the conditions this will be full accord and satisfaction of all outstanding accrued debt through December 15, 2011, whether known or unknown, and LRH will waive, in writing, all rights to litigation based on these claims, and will dismiss this claim on all debt accrued through December 15, 2011.  Voting against the motion: Pat Hickerson.  Motion carried.  The County Attorney will draft a Settlement Agreement that will be sent to the interim CEO of LVMC, Rebecca Brewer, so that a finalized Agreement can be signed prior to the end of the year deadline.  The Board thanked Commissioners Whiteman and Hickerson for their work in the negotiation process.

Commissioner Whiteman was excused from the remainder of the meeting due to other obligations.

Deputy County Attorney Darrough reviewed a letter she recommended be sent to the Bunker Road landowners.  She stated the earlier Public Notice stated objections to the alteration of Bunker Road and claims for damages are due to the County Clerk by noon on January 3, 2012.  However, the Appraisers’ report regarding the amounts of potential damages to landowners if the alteration were to occur is not due until February 10, 2012.  So, in fairness to the landowners, she recommended that the amount of damages claimed by each landowner does not have to be due until February 17, 2012; however, written notice of a claim or objection to the alteration must still be filed by the January 3, 2012 noon deadline.   Dennis Christensen moved, Pat Hickerson seconded, to approve the letter to landowners that clarifies the dates to submit claims and actual amounts.  Motion carried unanimously.

There being no further business, Travis Becker moved, Dennis Christensen seconded, to adjourn the meeting at 2:25 p.m. and reconvene for a Regular Meeting at 9:00 a.m. on January 3, 2012.  Motion carried unanimously.

The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present:  Chairman Douglas L. Thompson, Dennis Christensen and Travis Becker.  Vice-Chairman Pat Hickerson was absent for personal reasons and Commissioner Whiteman joined the meeting at 10:15 a.m. due to other obligations. County Clerk and Clerk of the Board Julie A. Freese was present for the meeting. 

Dennis Christensen moved, Travis Becker seconded, to approve the Agenda as amended.  Motion carried unanimously.   

Travis Becker moved, Dennis Christensen seconded, to approve the Minutes of the Regular Meeting held December 13, 2011.  Motion carried unanimously.

Dennis Christensen moved, Travis Becker seconded, to accept the regular bills for payment, with the exception of a one month rental agreement for a client of the CAST program, pending further information. Motion carried unanimously.  Later in the day after clarification of the location of the rental, Travis Becker moved, Dennis Christensen seconded, to pay the one month rent for a client of the CAST program until she can seek employment and sustain the rent on her own..  Motion carried unanimously.  The Board acknowledged an amended voucher to Hudson’s Funeral Home that was changed from the earlier approved amount of $2,300 to $2,095, based on actual mileage costs.  They further stated they would like clarification on a voucher to The Stock Doc from the department that accrued the late charge. 

Dennis Christensen moved, Travis Becker seconded, to accept a voucher from EBMS for health insurance claims in the amount of $152,398.37.  Motion carried unanimously.

Dennis Christensen moved, Travis Becker seconded, to accept a voucher from Fremont Counseling Service in the amount of $2,880 and from Lander Valley Medical Center in the amount of $1,950 for Title 25 patients.  Motion carried unanimously.  Travis Becker moved, Dennis Christensen seconded, to approve a letter to LVMC regarding a reduction in reimbursement for one patient based on a reduction in approved days.  Motion carried unanimously.

Emergency Management Coordinator Kathi Metzler was in the audience to answer questions regarding a Wyoming Office of Homeland Security form listing Fremont County’s proposed program budget for Fiscal Year 2012.  She stated the information is basically a change from the County’s format to the State’s, but includes the same funding.  Travis Becker moved, Dennis Christensen seconded, to approve the Wyoming County Proposed Program Budget as presented.  Motion carried unanimously.

The following items in the Signature File were reviewed: 1) Record of Proceedings; 2) letters to various outgoing County Board members; and 3) letter to University of Wyoming Cooperative Extension Service reiterating the County’s preference for the hiring of a Nutrition and Food Safety Specialist instead of a Community Development Education Specialist.  Travis Becker moved, Dennis Christensen seconded, to accept a Legal Services Contract between Fremont County and Terrance R. Martin to provide legal services to the County for review of evidence, filing and litigation of Title 25 involuntary hospitalization cases, pending correction of dates.  Motion carried unanimously.

Travis Becker moved, Dennis Christensen seconded, to approve Resolution No. 2011-33.  Motion carried unanimously.

RESOLUTION NO. 2011 –33

APPOINTMENT OF SPECIAL PROSECUTOR

                WHEREAS, the County and Prosecuting Attorney for Fremont County has entered into an agreement with Brett L. Johnson, County and Prosecuting Attorney in and for Sweetwater County, Wyoming, to prosecute a case (State vs Angela Ladd – CR-2011-0763), in which the Fremont County and Prosecuting Attorney’s Office has either a conflict of interest or which would have the appearance of impropriety if pursued by that office; and

                WHEREAS, Gregory J. Blenkinsop, designee of Brett L. Johnson, will provide his services free of charge to Fremont County, except that the Fremont County and Prosecuting Attorney’s Office shall reimburse for all costs and expenses from funds appropriated in that office’s budget; and

                WHEREAS, Wyoming Statutes 18-3-302 and 18-3-107 authorize such appointment with the consent of the Board of County Commissioners and said action provides a substantial benefit to Fremont County.

                NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Fremont County, Wyoming hereby consents to the appointment of Gregory J. Blenkinsop, designee of Brett L. Johnson, to serve as a special deputy county and prosecuting attorney in a particular case.

Travis Becker moved, Dennis Christensen seconded, to approve the 2010 distribution of $18,682 in Petersdorf Hospital Trust Income as follows:  $9,341.00 (50%) to the REACH Foundation for further distribution to the Riverton Senior Citizens, Inc., Sepiternal Society, Inc., Fremont County Hospice and other such institutions or organizations providing medical services or benefits and comforts for older people not otherwise available in the Riverton area as determined by the REACH Foundation; $6,725.52 (36%) to the Lander Senior Citizens; $1,120.92 (6%) to the Dubois Senior Citizens Center and $1,494.56 (8%) to the Shoshoni Senior Center.  Motion carried unanimously.

Chairman Thompson reviewed an Office of State Lands and Investments Board letter regarding an Easement Application submitted by Fremont County for a 20 foot easement for the Heritage Trail across State land.  Said letter stated the cost is estimated to be $1,040.38 and per State Statute, the County must remit a deposit of 75% of the estimated consideration for the proposed easement.  Travis Becker moved, Dennis Christensen seconded, to approve the amount of $780.29, being 75% of the estimated consideration for that portion of the Heritage Trail crossing State land.  Motion carried unanimously.

The Commissioners reviewed a letter from Assessor Berg, and specifically related to the Commissioners, a recorded Right-of-Way Deed on a Truck Trail that lies along an easterly part of said landowner’s property.  She will keep the Board informed of the landowner’s subdivision status and questions relating to agricultural classification.

Public Health Nursing Supervisor Julie Twist revisited the Board and provided additional information regarding her request to submit a grant application to the State of Wyoming for the Family Planning program to be administered by Public Health.  She presented additional information to answer abortion related concerns that several members of the Board had earlier expressed.  She reviewed a draft grant application and specifically referred to the appointment of a board, quality assurance and financial issues, all of which were expressed as concerns during the previous discussion.  A motion had been made at the December 13^th meeting to submit the grant application; however, failed on a three to two vote.  Chairman Thompson stated that procedurally, a member of the prevailing side must bring the motion back to the table, those members being himself, which he did not feel was appropriate, Vice-Chairman Hickerson, who was absent, or Commissioner Becker.  Commissioner Becker stated he still could not support the grant application, based on abortion related concerns.  High school student parent Pennie Buffington was in the audience and expressed her support of the program.  Since no action could be taken at this time, the Board continued to take the matter under advisement.

Transportation Superintendent Dave Pendleton stated he would be assembling follow up letters to three Atlantic City landowners following the December 8, 2011 meeting he had with them.  Staff Engineer Bill Masson is working on the Diversion Dam Bridge replacement project.  Pendleton stated the appraiser hired for the Mortimore Lane Bridge replacement project is not able to complete the needed work in the required time frame so the Wyoming Department of Transportation will take over and get an appraisal completed so they can begin landowner negotiations.

In other business, Dave Pendleton stated he met with the viewer that was selected by the Commissioners as part of the alteration process for Bunker Road.  The Viewer, Don Beard, had subsequently submitted his report via e-mail this date with a signed copy expected later in the day.  Dennis Christensen moved, Travis Becker seconded, to conditionally accept the electronically submitted Viewer’s Report, with the final signed copy expected later in the day as the prevailing report.  Motion carried unanimously.  The Board also reviewed a Public Notice compiled by the County Attorney’s Office for submission to the newspaper, for clarification that will state the current route of Bunker Road is the road on the ground from where point number 3 on the survey converges with, and is overlaid by, King Drive.  It further states Bunker Road, overlaid by King Drive, extends to point 8 on the survey and then proceeds, as travelled on the ground, through point 19 on the survey.  The appropriate legal description is also included.  Dennis Christensen moved, Travis Becker seconded, to approve the Public Notice for publication in the newspaper and distribution to affected landowners.  Motion carried unanimously.

Dennis Christensen moved, Travis Becker seconded, to adjourn into Executive Session with Fremont County Ambulance Director Lauri Wempen regarding personnel and potential property acquisition.  Motion carried unanimously.  Dennis Christensen moved, Travis Becker seconded, to return to Regular Session.  Motion carried unanimously.

Commissioner Whiteman joined the meeting at this time.

County Planner Ray Price presented a plat for the Vacation of Lots 4 & 5, Iiams Subdivision.  The landowners are petitioning for the vacation of the two lots from this subdivision because they have not been sold and are part of a larger haying operation.  The petition was approved by the Fremont County Planning Commission during their December 15, 2011 meeting on a unanimous vote.  Travis Becker moved, Keja Whiteman seconded, to approve the Vacation of Lots 4 & 5, Iiams Subdivision.  Motion carried unanimously.

Ray Price submitted Sandstone Mesa Subdivision, a Re-Plat of Viola’s Ridge Subdivision.  He stated this is a change of name for the simple three lot subdivision and was recommended for approval by the Planning Commission on a unanimous vote.  Travis Becker moved, Dennis Christensen seconded, to approve the Sandstone Mesa Subdivision.  Motion carried unanimously.

In final business, Ray Price stated John and Dana Smith are the sole owners of the Frontier Park Subdivision, consisting of a total of 35 acres and they wish to vacate the subdivision and return it to agricultural use.  The proposal was recommended for approval by the Planning Commission on a unanimous vote.  Travis Becker moved, Keja Whiteman seconded, to approve the vacation of Frontier Park Subdivision.  Motion carried unanimously.

County Coroner Ed McAuslan continued discussions regarding the Veterans Indigent Burial Policy.  The Board had earlier denied full payment to Hudson’s Funeral Home for a veteran indigent burial in the amount of $6,099.  The County’s policy states “the amount expended for preparation of the body shall not exceed $1,800.  The amount expended for the transportation of the veteran’s body shall not exceed $500”.  McAuslan again distributed copies of State Statute § 19-14-101(a) Burial of Indigents, stating in part “The board of county commissioners of each county shall provide for the preparation of the body and transmittal to and burial in the veteran’s cemetery or any other than a dishonorably discharged veteran ……….and who dies leaving insufficient funds to defray the necessary funeral expenses”.  The Board had then made the following motion on December 13, 2011 to authorize payment of $2,300 to Hudson’s Funeral Home for an indigent veteran burial, as per policy, with the balance being funded by the Coroner’s Department budget.  Discussion was held regarding the need for more clarification in State Statutes regarding actual amounts.  McAuslan informed the Board that the indigent veteran may have property, however, based on a County Attorney’s verbal opinion, stated his office had no right to secure that property.  The Board stated they would revisit the policy in January so the County Attorney can clarify that opinion.

In another continuing issue, Coroner McAuslan reiterated his request to have the light bar and siren purchased for the two Coronor’s Office suburbans remain on the vehicles, as they were both approved for purchase with the added equipment with funding through the Capital Revolving Fund.  The Board had earlier made a motion to have the light bars and sirens removed and replaced with recycled light bars and siren units from Sheriff’s Office vehicles that are being removed from the fleet. In closing, McAuslan stated it would be counter productive to take the time and labor to remove the light bars and sirens.  No further action was taken to McAuslan’s request at this time.

Keja Whiteman moved, Dennis Christensen seconded, to adjourn into Executive Session regarding personnel with Fremont County Museum Board members Tom Duncan, Butch Tonkin, Steve Banks and Jon Lane.  Motion carried unanimously.  County Attorney Brian Varn joined in mid session.  Dennis Christensen moved, Keja Whiteman seconded, to return to Regular Session.  Motion carried unanimously.

Wyoming State Legislators joined the Commissioners for a work session to discuss various issues of  importance to Fremont County.  Present were Senators Cale Case and Eli Bebout and Representatives Del McOmie, Rita Campbell and David Miller.  Items discussed were Optional 1% Projects submitted by the Fremont County Transportation Department totaling $72,971,000; Road Construction Fund 5-Year Prioritized Plan; one time state funding; BLM Resource Management Plan, Legislative Redistricting; Solid Waste issues; BIA joint jurisdiction possibility regarding motor vehicle code; Indigent Burial statutes.  In closing, the Commissioners thanked the Legislators for the opportunity for open discussion and feedback.  The Commissioners further stated their appreciation of the increased access to the Governor’s Office and staff, as Chairman Thompson stated the Governor has assigned a staff member to attend the upcoming cooperators meetings taking place in Rock Springs regarding the Resource Management Plan revision process.
