W.S. 20-1-101 THROUGH 20-1-113
Wyoming does not allow same sex marriages.
  20-1-101.  "Marriage is a civil contract between a male and a female person to which the consent of the parties capable of contracting is essential."

Minimum Age of Applicants:  20-1-102 (a) "At the time of marriage the parties shall be at leas sixteen (16) years of age except as otherwise provided.  (b)  All marriages involving a person under sixteen (16) years of age are prohibited and voidable, unless before contracting the marriage a judge of a court of record in Wyoming approves the marriage and authorizes the county clerk to issue a license therefore.  (c)  When either party is a minor (ages 16-17), no license shall be granted without the verbal consent, if present, and written consent, if absent, of the father, mother, guardian or person having the care and control of the minor.  Written consent shall be proved by the testimony of at least one (1) competent witness."

Application Process in Fremont County:

20-1-103 (b)  "Application for a marriage license shall be made by the parties to the marriage before the license is issued.  Upon receipt of an application, the county clerk shall ascertain by the testimony of a competent witness and the applicant, the names, the social security numbers of the parties who have vallid social security numbers, residences and ages of the parties and whether there is any legal impediment to the parties entering into the marriage contract according the laws of the state of their residence." Procedure:

  1. Both parties must be at least 18 years of age.  Parties who are 16-17 may get an application, however, we will need a written consent of their parent and they must have custody.  Parties who are under the age of 16 must have a court order to apply for a license.

  2. We need both applicants in our office if possible.

  3. If only one applicant can be in out office, they must have a copy of their intended husband/wife's identification and they will have to bring a witness that can give social security numbers, residence and age of the missing party.  They will also be swearing that there is no legal impediment to the two people getting married.
